AND MUTT ENTERPRISES LTD. PLAN 1OM-749 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ROADWAYS AND STORM DRAINAGE SYSTEM RECOMMENDATIONS: It is respectfully recommended that the General Purpose and and Administration Committee recommend to Council the following: 1. THAT Report WD-73-89 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' dated September 11, 1989 for the roads, drainage works and street lights constructed in Stage II within Plan 1OM-749; and 3. THAT Council approve the by-law attached to this report (WD-73-89) assuming the streets within Plan 1OM-749 as public highways, and assumed by the Town for public use. REPORT 1. ATTACHMENTS No.l: Key Plan showing location of 1OM-749 (Stage I and Stage II) . .. .2 105 ..E , IDI9OBT 0O° : W}-73-89 PAGE 3 ________________________________________________________________________________ 2. 8ACDGIX}00D 2.1 The Town entered into a subdivision agreement on July 13, 1981, with East Woodbridge Developments Ltd. and Mutt Enterprises Ltd. to develop lands by plan of subdivision, commonly referred to as the Rills of Liberty' located in the former 'Iowoabip of Darlington and described an Plan 10M-749 (see 8±tanbneut 0o.1) . The agreement required East Woodbridge Development Ltd. et al to construct roads, including hot-mix paving and granular shoulders, sodding of ditches, drainage works and street lighting. 2^2 Stage Z (Rebecca Court, Pamela Court and Avi Court) , was constructed and placed on maintenance on July 22, 1985' for Stage Z as recommended in Report VD-50-85 (July 15, 1985) . 2.3 Stage II construction (see Attachment 0o^1) commenced in April, 1985 and on February 2, 1987, a 'Certificate of Completion' was issued for the works which were placed on a two year final maintenance period. The two year maintenance period expired on February 2' 1989, and the *ncko have been re-inspected and have been found to be satisfactory. 3.4 It in now appropriate to issue a "Certificate of Acceptance" of the *wcko in Stage II thereby accepting ownership of the roads, drainage *wzko and street lights. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of 0nouniI. 2.5 Further to the ioaoaooe of a "Certificate of Acceptance" , a by-law is required for both Stage I and II allowing for the Tbwo to assume the streets within Plan IOM-749. . . .3 U 107 | J 4 REPORT NO. : 90}-73-89 PAGE 3 ________________________________________________________________________________ 3"8 RECOMMENDATION 3.1 It is, therefore, recommended that the Director of Public Works be authorized to issue a "Certificate of Acceptance" for the roads, storm drainage system and street lights within Plan 10M-749 and that Council approve the By-law attached to this report (WD-73-89) assuming the streets within Plan 10M-749° BeapeottoIIv submitted, Recommended for presentation to the Committee, Walter A. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT the streets described in Registered Plan 1OM-749 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land registry office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-749.
