THAT Report PD -91 -89 be received; and 2. THAT the rezoning application DEV 89 -001 submitted by Bernard Kamin on behalf of Mosport Park Ltd. to reflect current Mosport Park Ltd. ownership and to accommodate expansion of existing motor sport facilities and related events be approved and that the attached By -law be passed; and 3. THAT a copy of the Amending By -law be forwarded to the applicant and all interested parties attached hereto. 1. BACKGROUND 1.1 In January 1989, the Town of Newcastle Planning and Development Department received an application to amend the Town of Newcastle Zoning By -law 84 -63, as amended. The application was submitted by Bernard Kamin on behalf of Mosport Park Ltd. The rezoning application if approved would recognize reflect current Mosport Park Ltd. ownership and accomodate expansion of existing motor sports facilities and related events. 1 029 REPORT NO.: pp_91_89 PAGE 2 1.2 The subject site is located in Part Lots 33, 34 and 35, Concession 9, former Township of Clarke. It is bounded on the west by the Darlington - Clarke Townline, to the north by Concession Road # 10, to the east by Mosport Road and to the south by the unopened road allowance between the 8th and 9th Concession. Adjacent land uses are primarily Agricultural along with some rural residential and extractive industrial. 2. PUBLIC NOTICE & SUBMISSION 2.1 Staff would note for the Committee's information that, pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands and, surrounding property owners were advised of the said application and Public Meeting. 2.2 Staff note one letter of concern was received from Mr. and Mrs. Webb. However, the letter appears to confuse this rezoning application, with the earlier Official Plan Amendment application also submitted by Mosport Park Ltd. 3. OFFICIAL PLAN CONFORMITY 3.1 Within the Durham Regional Official Plan the subject property is designated Major Open Space - Oak Ridges Moraine. The predominant use of lands so designated is for agriculture and farm related uses. Conservation and related uses are also permitted within said designation. In addition recreational uses may be allowed in the Zoning By -law provided such recreational use is compatible with surrounding uses and in conformity with the intent of the Plan the proposed rezoning appears to conform to the Official Plan. ...3 1030 REPORT NO.: PD -91 -89 PAGE 3 -.----_-m--®-_-®®--.-®-®--___-®-_®d®-_-_.------®--m®-_---_®_--_-®-®-----.----®®--®- 4. CIRCULATES AGENCIES 4.1 To date comments remain outstanding from four (4) of the circulated agencies. These include Regional Planning, Regional Public Works, Ministry of the Environment and Ontario Hydro. Of the agencies which have commented to date all have replied with no objection to the proposal. These include Newcastle Public Works Department, Newcastle Fire Department, Ganaraska Conservation Authority, Regional Health Department, Ministry of Agriculture and Food and Ministry of Natural Resources. 5. STAFF COMMENTS 5.1 Staff note the purpose of the application is to rezone the lands presently under the ownership of Mosport Park Limited, to "Agricultural Exception (A -21)" which is consistent with zoning of the abutting lands presently used for motor sport facilities. This rezoning application is in no way related to Mosport Park's Official Plan Amendment application which involved a seasonal housing proposal as well as a number of nes recreational activities. 5.2 As noted above all commenting agencies which have responded noted no objection to the proposal. Staff have received verbal comments from Regional Planning which also indicate no objection. Approval of this rezoning application would not affect Regional Services, therefore Regional Public Works Staff should not have any concerns. ...4 1031 REPORT NO.: PD -91 -89 _______ _______________________________ 6. RECOMMENDATION PAGE 4 _ _______________________________ 6.1 In consideration of the above-noted comments, Staff would have no objection to the rezoning application as submitted, to rezone the subject lands to reflect current Mosport Park Ltd. land ownership and to accomodate expansion of existing motor sports facilities and related events. RD. 8 W U Z U o Pok W U Z U 1 - • 1 1 1033 A/A21 THE CORPORATION OF THE TOWN OF NEWCASTLE BY -LAW NUMBER 89- being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law of the Corporation of the Town of Newcastle. { WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By -law 84 -63, as amended, of the Corporation of the Town of Newcastle to allow the expansion of the existing motor sports facilities and related uses as applied for (DEV 89 -001). NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows; 1. Schedule 112" to By -law 84 -63, as amended, is hereby further amended by changing the zone designation from "Agricultural (A)" to "Agricultural Exception (A -21)" Zone as shown on the attached Schedule "X" hereto. 2. Schedule "X" attached hereto shall form part of this By -law. 3. This By -law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
