SLBJECT: OFFICIAL PLAN AMENDMENT
ZONING BY -LAW AMENDMENT
APPLICANT: TOM SIMPSON - NEWCASTLE GOLF COURSE
PART LOT 20, CONCESSION 2, FORMER TOWNSHIP OF CLARKE
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD-93-89 be received for information.
1. BACKGROUND
1.1 On December 12, 1988, Committee had before them Staff Report PD- 271 -88
in consideration of an application to amend the Durham Regional
Official Plan and the Town of Newcastle Comprehensive Zoning By -law
84 -63, as amended. (attached hereto) The application would permit the
creation of three (3) non -farm rural residential lots.
1.2 The Staff Report recommended denial of the proposed amendments, noting
that the propsed lots did not meet the criteria for definable node or
cluster as delineated in the Regional Official Plan, therefore was
contrary to the intent of the policies for rural residential
development.

1.3 on December 12, 1988, Committee recommended approval the proposed
amendments and was subsequently approved by Council on December 19,
1988. Accordingly, Council's decision was forwarded to the Region of

Zoning By-law is refused that person/agency may appeal such o decision
to the Ontario Municipal Board.
1.6 Since Regional Council has made a decision contrary to Town Council's
recommendation, Staff is drawing this matter to Council's attention
and, in the event Town Council wishes to further pursue this matter, it
has the right under the Planning Act to request referral of the
official Plan Amendment to the Ontario Municipal Board. However, Staff
would not recommend such action. If this matter is to be pursued, it
abVuId be up to the applicant.
