AND ANTHONY AND RITA KLOMPMAKER PLAN 1OM-768 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ROADWAYS AND STORM DRAINAGE SYSTEM RECOMMEPdDATIOtdS: It is respectfully recommended that the General Purpose and and Administration Committee recommend to Council the following: 1. THAT Report WD-71-89 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system and street lighting constructed within Plan 1OM-768; and 3. THAT Council approve the by-law attached to this report (WD-71-89) assuming the streets within Plan 1OM-768 as public highways, and assumed by the Town for public use. REPORT 1. BACKGROUND 2.1 The Town entered into a subdivision agreement on September 23, 1985, with 464367 Ontario Ltd. and Anthony and Rita Klompmaker to develop lands by plan of subdivision, located in the former Township of Darlington and described as Plan 1OM-768 (see Attachment No.l) . The agreement- required 464367 Ontario Limited and Anthony and Rita Klompmakerr to construct a storm drainage system, roads, including hot-mix paving and granular shoulders, sodding of ditches and street lighting. 10 10 . . .2 BElv]DT 0O~: WD-71-89 PAGE 2 -------------------------------------------------------------------------------- 2.3 on September 28, 1987, a 'Certificate of Completion' was issued and the works were placed on a one year final maintenance period which expired on September 28, I988^ These works were subsequently re-inspected and were found to be satisfactory. 2"3 It is now appropriate to issue a "Certificate of Acceptance" dated September Il, 1989, for these *nrha, thereby accepting ownership of the roads, storm drainage system and street lights. The subdivision agreement provides for this certificate to be issued by the Director of Public works, subject to the approval of Council. 2°4 Further to the ios000ne of a "Certificate of Acceptance" , a by-law is required permitting the Tbnu to assume all the streets within Plan IOM-768^ 3.0 RECOMMENDATION 3"I It is, therefore, recommended that the Director of Public Works be authorized to issue a "Certificate of Acceptance" for the roads, storm drainage system and street lights within BIau IOM-708 and that Council approve the By-law attached to this report (V0}-73-89) assuming the streets within Plan 1OM-768. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follows: 1. THAT the streets described in Registered Plan IOM-768 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land registry office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-768.
