BACKGROUND 2.1 Report WD-39-89 (Attachment No.2) recommended that the following requests for street name changes be dealt with in aoonzdaooe with the procedure established in Section 210 (105) of the Municipal Ant" I) To change the street name of the road between Lots 4 and 5, Concession 6' former TzwuobiD of Clarke from Gbilnb Road to Langstaff Road. 2) To change the street name of the road between Lots 32 and 33, Concession 3 and 4, former Township of Clarke from Pollard Boa] to Bowen Road. 3) 'In name the cnod in Lot 5, between Concessions 8 and 9 former Township of Clarke, McMillan Boad. ' 11 U U� ~) | �� REPORT NO. : WD-63-89 PAGE 3 --------------------------------------------------------------------------------- 2.2 The issue of Langstaff/Shiloh Road has been before Council on several occasions. 1) Report CD-61-87 approved by Council, denied the request to change the road's name from Langstaff to Shiloh. 2) Report WD-32-88 recommended the name be changed from Langstaff Road to Shiloh Road in Concession 5 and 6 and as a result of of the process, a petition from residents in Concession 6 was received requesting the name remain Langstaff Road in Concession 6. 3) Report WD-29-89 presented the above requests to Council and recommended the proposed changes be advertised in the form of an amendment to By-Law 86-112. 2.3 The proposed amendments to By-Law 86-112 were advertised for four consecutive weeks and the recommendations in this report are based on the response of the residents affected by the proposed changes. 2.4 Based on the response received as a result of the advertising of the proposed By-Law, a draft of Report WD-63-89 was prepared and mailed to the petitioners to advise them of our findings and recommendations. This generated several additional responses from the property owners adjacent to Shiloh load and the report has been rewritten to include these responses. 3. REVIEW AND COMMENT 3.1 Shiloh Road back to Langstaff Road 3.1.1 WD-32-88, Section 3.2 states that in the case of the changing of the name from Langstaff Road to Shiloh Road in May, 1988, the request was not published and the owners of the properties adjacent to the road were not notified of the request that the name be changed. Draft Report VD-63-89 was prepared as a result of the petition from residents in Concession 6 to have the road allowance in Concession 5, only, changed book to Langstaff Road. 3~I.3 Assessment roles have been reviewed and abutting property owners identified. The majority of residents in Onuoeoaicm 6 who have signed the petition are in favour of the name Langstaff Road. 3.1^4. The advertising of the by-law generated only one letter in support of / of the name Shiloh Road. (Attachment 0o. 5a) . Boweverr, circulation of Draft Report V0}-63-89 generated additional correspondence which was received on June 21, 1989 from the following property owners (Attachment 5b-5g) in support of the name Shiloh Road: I) Jnbo Matheson (Concession 6) 2) T.6 E. Kay (Concession 5) 5) Lozcl/ 6 Marion Maudezo (Concession 6) 6) Ken 6 Shirley Prescott 3^I.5 Key Maps & G B (Attachment 0U.9) shows abutting property owners in Couoeooicmo 5 and 6 and their preference to the Dcu2oaed name change. 3"1.4 Responses to the advertised amending by-law and circulation of Report WD-53-89 were in support of the name Langstaff Road in Concession 6 between Lots 4 and 5° Total Residents: 10 Langstaff Road : 5 Shiloh Road : 4 No response : I . . .5 REPORT NO. : WIC-63-89 PAGE 5 3.2 Pollard Road to Bowen Road 3.2.1 Bruce Jensen Nurseries Inc. have protested the request for street name change for business and financial reasons (Attachment No.6) . 3.2.2 Objections were received from other residents in favour of the name Pollard Road (Attachment No.7) . 3.3 Road Allowance in Lot 5, between Concessions 8 and 9, former Township of Clarke to be named McMillan Road. 3.3.1 No objections were received. 4. CONCLUSIONS AND RECOMMENDATIONS 4.1 It is recommended that the road allowance between Lots 4 and 5, Concession 6, former Township of Clarke be changed from Shiloh Road to Langstaff Road for the following reasons: a) Five of the property owners who live adjacent to the road have indicated that they favour the name Langstaff Road and four have indicated that they favour the name Shiloh Road. b) The name was changed from Langstaff Road to Shiloh Road in 1988 without going through the procedure established in Section 210 (105) of the Municipal Act. 4.2 Since no one has objected to the name Shiloh Road in Concession 5, it is recommended that no change be made in Concession 5. ...6 n r° REPORT NO.: WD-63°89 PAGE 6 4.3 Jensen Nurseries have indicated that changing the name of Pollard Road would cause considerable expense and confusion to their business. It is, therefore, recommended that no change be made to the street name Pollard Road. 4.4 The request to name the road allowance in Lot 5, between Concession 8 and 9, former Township of Clarke has received no opposition. Attachment N0.7: Plan showing the location of West Townline Road. 2.0 BACKGROUND 2.1 At a regular meeting of the General Purpose and Administration Committee I held on May 16, 1988 the recommendations made in Report WD--32-88 were adopted by Committee and subsequently approved by Council on May 23. 2.2 The recommendations in the report dealt with several requests for street name changes and included the change of the name of the road between Lots 4 and 5, Concession 5 and 6, former Township of Clarke from Langstaff Road to Shiloh Road. This recommendation was made in response to a request made by Mrs. Wilma Martinell in 1987 to change the name of Langstaff Road to Shiloh Road. The effect of this name change was that the road between Lots 4 and 5, 1 in Concession 5 and 6, former Township of Clarke is named Shiloh Road and in Concession 7 and 8 is named Langstaff Road. 2.3 At a meeting held on September 26, 1988 Council considered a letter received from Mrs. Elizabeth Sullivan submitting a petition from residents from Langstaff Road objecting to the changing of Langstaff Road to Shiloh Road and requesting that the name be changed back to Langstaff Road between Durham Road 9 and Concession Road 6. The effect of this name change is that the road between Lots 4 and 5 would be named Shiloh Road in Concession 5 and Langstaff Road in Concessions 6, 7 and 8. i i Page WD-29-89 i 3.0 REVIEW AND COMMENT 3.1 By-Law 86-112 which was passed by " ,✓ 28, 1987, established the names of all streets in the Town of Newcastle, prior to the passing of the by-law, the plans detailing the names proposed for the streets and roads in the Town were circulated, posted and published in an effort to reach and inform as many people as possible. The process took several years, a number of reviews by Council and the Public and the plans and street names were posted at strategic locations in the Town. In every case, the public were requested to review the material and to co on the names given to each road and street . 3.2 In the case of the changing of the name from Langstaff Road to Shiloh Road in May, 1988, the request was not published and the owners of the properties adjacent to the road were not notified of the request that the name be changed. 3.3 The Municipal Act establishes procedures to be used in changing the name of a highway (highway means a common or public highway and includes the streets) . Specifically, Section 210 (105) provides as follows: To provide for surveying, settling and marking the boundary lines of highways and giving names to them or changing their names, and for affixing the names at the corners thereof, on public or private property. a) A by-law changing the name of a highway has no effect until a copy of it, certified under the hand of the Clerk and the seal of the Corporation, has been registered in the proper registry office. b) "before passing a by-law for changing the name of a highway, i) notice of the proposed by-law shall be published at least once a week for four successive weeks in a newspaper having a general circulation in the municipality, and ii) the Council shall hear any person who claims that he will be adversely affected by the by-law who applies to be heard. E 1 12- i 9-8') 3.4 In addition request to change the road name Shiloh Road back to i�angstaff Ro, (j, w�, have the following other requests for street name changes: 1) Request from Mr. Ernest J. Bowen that Pollard Road located between Lots 32 and 33, Concession 3 and 4, former Township of Clarke be. changed to Bowen Road (see Attachment- No.4 and No.7) 2) Request from the City of Oshawa that the Town adopt Townline Road (north and south) as the legal name for the boundary street between the former Township of East Whitby and the former Township of Darlington for that portion of the street which is under the jurisdiction of the Town (see Attachment No.5 and 8) f I 3.5 In addition to the above a request has been received Mr. J. F. McMillan to name the road in Lot 5, between Concession 8 and 9, former Township of Clarke, McMillan Road (see Attachment No. 6 and 7) . At the present time this road does not have a name. 3.6 Cost The cost to publish requests for street name changes in the local newspapers and the cost of Staff time to process the applications is about $1,500. 4.0 CONCLUSIONS AND RECOMMENDATIONS 4.1 Requests to change the name of streets should be dealt with in accordance with Section 210 (105) of the Municipal Act. 4.2 Processing requests for street name changes in accordance with Section 210 (105) of the Municipal Act is expensive. 5.0 RECOMMENDATIONS 5.1 It is recommeded that: A) The requests for street name changes outlined in this report be dealt with as provided in S((ction 210 (105) of the Municipal Act, I� UJ' 1. 3' Page 6 WD-29-89 I I B) Council r>as:> a By-I,aw establishing that requests for street name changes be dealt with accordance with the procedures established in Section 210 (105) of the Municpal Act and that there be a charge of $100 to the applicant. Firstly, we have been using the address Langstaff Road for 6 months when the sign Langstaff Road was put up. We had been notified 2 years in June of the new address. Secondly, because we have been using Langstaff Road for 6 months my husband and myself have both drivers licence and passports registered. Stationary for kennel and subscriptions to magazines and correspondence. Langstaff Road at the cross roads on Durham Road 9 would be easy to see when giving directions to police and fire trucks in case of emergency. This road is completely separate from Shiloh Road. I prefer that the name remain as "Shiloh Road" . It seems like a frivolous reason to go to the expense and time involved to change the name back because it is inconvenient since she now uses Langstaf f on her driver' s licence. It is not required on a driver's licence, just the lot and Concession, and whether or not you use the road name is your choice. The inconvenience would be repeated again next year if it were changed back. I believe that we have an oblication to preserve the history of our area and what better way is there. At the present time the church is used for road directions. The name Shiloh Road gives easy direction to and from County Road No. 9. if they sincerely wish the name changed that desperately, each :esident could be asked to submit their valid reasons supporting I the change back to Langstaff. The truly interested persons would reply. To the best of my knowledge and according to documentation obtained from the local registry office and old maps, there is no mention of the Langstaff name south of County Road No. 9. I had previously told Mrs. Sullivan I would not interfere with her request but since changed my mind, as I stronciv believe the road allowance should remain "Shiloh Road" . f , 4 ATTACIMENT 110 , 2 1 7. The property owners across iron, us would like to be able to sell their farm inunediately. Therefore I doubt very much if renaming this road is high on their list of Priorities, but switching the name around every year could certainly be aggravating. Sorry for all the trouble I have caused but the. majority of people that I have received phone calls from are very pleased with the name "Shiloh Road" . A sincere "Thank You" to everyone for your help and understanding. It has been truly a learning experience. Hiram BOWen son of Bradford Bowen had one son Henry C. Bowen who later Purchased the north quarter of Lot 33. Henry Bowen was a noted orchardist, Purchasing the first orchard sprayer in Durham county. r The farm of Bradford Bowen was later split in half. wellington Bowen with the east half and Fred Bowen (his son) the west half. Fred Bowen was a member of parliament for three terms. Hector Bowen son of Henry Bowen bought the farm of James Jerome in 1927 and farmed until 1959. As there is only two lines in Professor Squair' s book on Clarke Township relating to the Pollards and no dates given, I beleive that relating to history of this section, the name of the road (now known) as Pollard's should be changed to Bowen Road. Our 300 acre farm is Lot 3 to Lot 4 on Concession IX of Clarke Township. We have been here for 110 years since my grandfather first purchased this land in 1877. Apparently up to this time you have not named this road and we would like to have a road number for our property. We are the only residents on this road between Langstaff Road and the Town boundary. Shiloh is not •a recggnized Hamlet designation , but is used for giving directions . For those persons using County Road No . 9 , removal of the Shiloh road name sign would totally confuse everyone trying to locate Shiloh . %T�UIENT [JO, 5A 10) 3 - z - Recently , Hemmings Sales and Service in Peterborough had a delivery to make to a resident located east- of Shiloh church . The directions give by the resident was to take County Road No . 9 to Shiloh Road located just west of the Hope/Clarke Boundary line and to follow Shiloh road until they came to the Church , then go east . From an amusing personal experience , we are located adjacent to Kendal , have a mailing address of R . R . #1 , Newtonville and have an Orono Phone number and now it would seem that the Town of Newcastle may be adding to the confusion by referring to the Langstaff Road , for anyone trying to locate the Shiloh area . In a rural community it would seem appropriate to have the road allowance between Lots 4 and 5 south of County Road No . 9 be named Shiloh Road as it leads directly south to "Shiloh" . Upon review of the road area map it seems that the Town of Newcastle has tried to relate road names with area locations such as the Dell Road leads directly to the Dell recreation area , the Cedar Valley Road leads to Cedar Valley , Cold Springs Camp Road leads directly to the Cold Springs Camp owned by the Ganaraska Conservation Authority . It would seem logical that if you followed Shiloh Road , you would arrive at the Shiloh Area . In a rural community like this one , .the proper mailing address is R . R . # l , Newtonville , Ontario . LOA 1JO . Liz Sullivan has expressed concern as she has changed her address to Langstaff Road . She therefore writes her address with reference to Langstaff Road and her number but neglects to include the Canada Postal address . You cannot replace your rural route with a street name . It would seem that the purpose of a road name sign is for convenience in locating an area or individual . County Road No . 9 is a heavy traffic road and a natural divider and therefore all roads leading off the County Road should be, very distinct from each other to avoid confusion and possible accidents when exiting from the County Road . in 3 - Since we are near the eastern boundry , Hope Zownship may be called in for assistance with a fire call . The Township fire department would be travelling westerly on County Road No . 9 and once they approached the intersection they would not know whether to go north or south on Langstaff road if it was extended to the 6th . Concession . When reporting an emergency situation the last thing anyone is going to remember is reference to north or south . During heavy traffic periods this could create added delays and problems for emergency vehicles . All that I ask , is that all elected officials give serious consideration to the matter prior to making a decision . Please keep in mind the expected increase in traffic as a result of the real estate boom in this area , and the increased use of County Road #9 Although I prefer the road to remain as named "Shiloh Road " , I trust that Your final decision will be in everyone ' s best interest . I can appreciate there is probably some nostalgic reason for this name change being requested. When the Town commenced naming the streets in Newcastle , we had no preference for any special name being allocated to our road and were quite happy to accept whatever decision was made by the Town, which we did. Now we regret we must oppose this proposed By-law for the following reasons:. 1 . When the Town published the fact that street names and addresses had been allotted, we contacted the Works Department to determine our actual physical address. This greatly assists our Company in directing customers (many of whom are international ) and supp- liers ( particularly couriers ) to our place of business . 2 . Report CD-61-87 approved by Council, denied the request to i change the road's name from Langstaff to Shiloh. Report WD-32-88 I recommended the name be changed from Langstaff to Shiloh and as a result j of the process, a petition from residents was received requesting the name remain Langstaff Road. The above requests were put before Council in Report WD-29-89 and the proposed changes were advertised in .the form of an amendment to By-Law 86-112. 2.3 The proposed amendments to By-Law 86-112 were advertised for four consecutive weeks and the recommendations in this report are based on the response of the residents affected by the proposed changes. II, 3. REVIEW AND CCMMENT 3.1 Shiloh Road back to Langstaff Road 3.1.1 WD-32-89, Section 3.2 states that in the case of the changing of the name from Langstaff Road to Shiloh Road in May, 1988, the request was not published and the owners of the properties adjacent to the road were not notified of the request that the name be changed. i 3.1.2 Objection in the form of a petition (Attachment No.3) was referred to Public Works for review and a report. 3.1.3 Assessment roles have been reviewed and abutting property owners identified. The majority of residents have signed the petition in favour of the name Langstaff Road. . . .4 1047 REPORT NO. : WD-63-89 PAGE 4 3.1.4 Responses to the advertised amending by-law were in support of the name Langstaff. (Attachment No.4) with the exception of one response (Attachment No.5) supporting the name change to Shiloh. 3.2 Pollard Road to Bowen Road 3.2.1 Bruce Jensen Nurseries Inc. have protested the request for.,street name change for business and financial reasons (Attachment No-6) . 3.2.2 Objections were received from other residents in favour of the name Pollard Road (Attachment No.7) . 3.3 Road Allowance in Lot 5, between Concessions 8 and 9, former Township of Clarke to be named McMillan Road. 3.3.1 No objections were received. 4. OPINION 4.1 Langstaff Road/Shiloh Road 4.1.1 The majority of responses received favour the name Langstaff Road. 4.2 Pollard Road/Bowen Road 4.2.1 Opposition to the name change from Jensen Nurseries indicates that changing the name would cause considerable expense and confusion from a business aspect. This recommendation was made in response to a request made by Mrs. Wilma Martinell in 1987 to change the naLme of Langstaff Road to Shiloh Road. The directions give by the resident was to take County Road No . 9 to Shiloh Road located just west of the Hope/Clarke Boundary line and to follow Shiloh road until they came to the Church , then go east . From an amusing personal experience , we are located adjacent to Kendal , have a mailing address of R . R . # l , Newtonville and have an Orono Phone number and now it would seem that the Town of Newcastle may be adding to the confusion by referring to the Langstaff Road , for anyone trying to locate the Shiloh area . In a rural community it would seem appropriate to have the road allowance between Lots 4 and 5 south of County Road No . 9 be named Shiloh Road as it leads directl.y south to "Shiloh" . Upon review of the road area map it seems that the Town of Newcastle has tried to relate road names with area locations such as the Dell Road leads directly ,to the Dell recreation area , the Cedar Valley Road leads to Cedar Valley , Cold Springs Camp Road leads directly to the Cold Springs Camp owned by the Ganaraska Conservation Authority . It would seem logical that if you followed Shiloh Road , you would arrive at the Shiloh Area . In a rural community like this one , the proper mailing address is R . R . #l , Newtonville , Ontario . LOA 1JO . Liz Sullivan has expressed concern as she has changed her address to Langstaff Road . She therefore writes her address with reference to Langstaff Road and her number but neglects to include the Canada Postal address . You cannot replace your rural route with a street name . It would seem that the purpose of a road name sign is for convenience in locating an area or individual . County Road No . 9 is a heavy traffic road and a natural divider and therefore all roads leading off the County Road should be.. very distinct from each other to avoid confusion and possible accidents when exiting from the County Road . i 3 - i Since we are near the eastern boundry , Hope Iownshi may be called in for a T assistance with Town.ship fire department would be travelling cwesterly eon County Road No . 9 and once they approached the intersection they would not know whether to go north or south on Langstaff road if it was extended to the 6th . Concession . When reporting an emergency situation the last thing anyone is going to remember is reference to north or south . During heavy traffic periods this could create added delays and problems for emergency vehicles . All that I ask , is that all elected officials give serious consideration to the matter prior to making a decision . Please keep in mind the expected increase in traffic as a result of the real estate boom in this area , and the increased use of County Road #9 Although I prefer the road to remain as named "Shiloh Road ' , I trust that your final decision will be in everyone ' s best interest . Barrie: I read with great concern in the March 29th edition of the Newcastle Independent a Proposed By-Law to change the name of the road on which our farm is located from Pollard Road to Bowen Road. I can appreciate there is probably some nostalgic reason for this name change being requested. When the Town commenced naming the streets in Newcastle , we had no preference for any special name being allocated to our road and were quite happy to accept whatever decision was made by the Town, which we did. Now we regret we must oppose this proposed By-law for the following reasons: 1 . When the Town published the fact that street names and addresses had been allotted , we contacted the Works Department to determine our actual physical address. This greatly assists our Company in directing customers (many of whom are international ) and supp- liers ( particularly couriers ) to our place of business . 2 . Based on the information received from the Town that our physical address now would be 13333 Pollard Road ' we underwent a very costly and time-consuming endeavour to have all our co3:porate stationery , including brochure , reprinted to incorpora,jk/'o�rj n address . The cost of print ' . e amounted to oT Thousands of copies of carious tationery, e/ ,sehave been printed and only now starting to go nto "'" aeon.
