Res. # By-Law # MEETING: GENERAL, PURPOSE AND ADMINISTRATION MEETING DATE: MAY 1, 1989 REPORT #: WD-46-89 FILE #: SIJ&JECT: DUST, NOISE AND GARBAGE IN VICINITY OF ABSEC PROPERTY DEVELOPMENTS VILLAGE OF NEWCASTLE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-46-89 be received for information. -®___-_--_e----------------__-----_m________-__,-__m__®__-___.__--_-®_--_----____---- REPORT 1.0 BACKGROUND 1.1 On February 27, 1989, Council passed the following resolution: "THAT staff be directed to prepare a status report for Council pertaining to building inspection, dust noise, and garbage being generated by Absec Property Developments in Newcastle." 1.2 The issue of building inspections have been addressed in a separate report (PD-84-89) . 1018 REPORT NO.: WD-46-89 PAGE 2 -------------------------------------------------------------------------------- 2.0 REVIEW AND COMMENT 2.1 The Absec Subdivision has been monitored for dust/mud tracking by the Public Works Staff since the fall of 1988. During this monitoring, garbage has not been noted as being a problem. 2.2 On several occasions, excessive mud had been tracked outside of the subdivision limits, particularly on Arthur Street. On these occasions, the developer's consultant was contacted and advised to have the road cleared immediately. 2.3 In this development the builder has a rubber tire backhoe on site, used to scrape the streets clear of mud and debris. This is done on a daily basis or as required. 2.4 Frequent rains and mild spring weather have compounded the problem of mud tracking in this subdivision, as well as all others presently undergoing new house construction. The tracking of mud is impossible to prevent and frequent monitoring and clearing is the best alternative. 2.5 Attachment No.1 is a copy of a letter which has been sent to the owners and their consultants for all subdivisions in Newcastle. 3.0 CONCLUSION AND RECOMMENDATION 3.1 Public Works staff have monitored the dust/mud tracking since February 27, 1989 and have found the level of mud to be acceptable and cleaner than comparable subdivisions in other areas. Inc. 483 King Street East Newcastle, Ontario LOA 1HO ATTENTION: Mr. Kumar Dear Sir: RE: ALL PROJECTS WITHIN THE TOWN OF NEWCASTLE Pursuant to the subdivision agreement please be reminded of your responsibilities with respect to the removal of winter sand and the required maintenance of all roads internal and external (where applicable) . All maintenance and clean-up shall be completed by April 21, 1989, to ensure a safe, well drained and well maintained driving surface is available. In the past, Town cleaning equipment was available for this purpose, however due to commitments with our existing road system this service is no longer offered. Developers will be expected to retain the services of a private company. If work is not completed by the above-mentioned date, the Town will be in a position to take matters into their own hands and have the work completed on behalf of the Developer, and invoice the developer accordingly including all associated administration and mobilization costs. Notwithstanding the above-noted, all roads shall be monitored regularly to ensure a mud free and dust free surface is maintained. Mud and dust shall be kept to an absolute minimum as directed by the Director of Public Works or his designate in an approved and consistant manner.
