Res. # `` By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION MEETING DATE: FEBRUARY 20, 1989 REPORT #: WD-32-89 FILE #: SUUCT: REQUEST FOR QUIT CLAIM DEED MYLES, ROBERT BRUCE, PART LOT 27, CONCESSION 1, GEOGRAPHIC TOWNSHIP OF CLARKE, VILLAGE OF NEWCASTLE RECOMMENDATIONS: It is respectfully recommended that- the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-32-89 be received; and 2. THAT the Mayor and Clerk be authorized to execute a Quit Claim Deed to release a right-of-way and easement on title to the property in Part of Lot 27, Concession 1, former Township of Clarke in the Village of Newcastle (see Attachment No.1) ; and I 3. THAT any cost associated with the request for Quit Claim be paid by the applicant; and i 4. THAT Irwin A. Hamilton, 1 Division Street, P.O. Box 39, Bowmanville, be advised of Council's decision. I REPORT i i 1.0 BACKGROUND 1.1 The Public Works Department has received a request for the Town of Newcastle to release an easement over part of Lot 27, Concession 1, former Clarke Township, in the Village of Newcastle (see Attachment No.2) . . . .2 ` Page 2 V0}-32-89 � ' 1.3 The property described above is the land immediately to the east of | Newcastle Fire Station #2 in Newcastle Village. | | 1.3 The easement is described as the easterly 5 feet of the northerly ! 75 feet of the laud, presently owned by Mr. Myles. � 1.4 The easement was acquired through the pocoboae of the land by the Town from William Cmzvetb in I975 (see Attachment 0o.3) . The Myles property was tb*u owned by Edmund Tbuckcay. 1.5 The easement was acquired to provide for installation of m pipe and line of pipes in from the well on the easterly property for water supply to the Fire Station and to enter the land with right-of-entry for the purpose of maintenance and repair. | | 3.0 RELEASE OF EASEMENT ! 2.1 The present owner, Mr. Myles, is attempting to sell the property and his solicitor has requested n release from the easement agreement with the Town of Newcastle. 3.2 The property is now serviced by Town water supply and the well is no longer used by the Town. 3.3 Jim Aldridge, Fire Chief, was consulted and be and Mr. S. Bzeretou, District Chief at Fire Station #3, Newcastle Village, both agree that the easement serves no purpose and will not be required in the future. 4.0 CONCLUSION 4.1 The easement is no longer required by the Town for water supply to Fire Station #2 and is of no foraeeabIe use to the Town. 5.0 D�CO����D��IO0 . | � 5.1 It is, therefore, recommended that the Mayor and Clerk be authorized to � to execute the Quit Claim Deed in favour of the applicant. � � Respectfully submitted, Recommended for presentation � to the | � | Walter A.
