Subject: ASSUMPTION OF ROAD WIDENINGS
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report LGL-001-13 be received;
2. THAT Council adopt the by-law attached to Report LGL-001-13 to establish
various road widening as public highways; and
3. THAT Council authorize the Municipal Solicitor to make an application to register
the By-law.

1.0 BACKGROUND
1.1 Through the development process, various road widening have been transferred
to the Municipality. When all development conditions have been satisfied, the
widenings require by-laws to have them assumed as public highways.
1.2 Preparing and registering the by-laws on an individual basis is not cost or time
effective. Accordingly, lands to be dedicated and assumed for public use have
been permitted to accumulate and combined in the by-law attached to this report.
2.0 RECOMMENDATIONS
2.1 The by-law attached to this Report has been prepared based on information
supplied by the Engineering Services Department. It is appropriate for Council to
adopt it.
3.0 CONCURRANCE
3.1 This report has been reviewed by the Director of Engineering Services who
concurs with the recommendations.

BY-LAW 2013-
being a by-law to establish
certain lands as public highways
WHEREAS the lands set out in the attached Schedule "A" have been conveyed to The
Corporation of the Municipality of Clarington or The Corporation of the Town of
Newcastle for road widening purposes.
NOW THEREFORE the Council of The Corporation of the Municipality of Clarington
hereby enacts as follows:
1. The lands shown in Schedule "A" are hereby dedicated and assumed as public
highways.
2. This by-law shall come into effect on the date of passage.

By subsection 1(2) of the Regional Municipality of Durham Amendment Act (Newcastle-
Clarington), 1993, S. O, 1993, c. 3, on July 1, 1993, The Corporation of the Town of
Newcastle was confirmed as a town municipality under the name of The Corporation of
the Municipality of Clarington. Subsection 4(1) of this Act deemed all references to The
Corporation of the Town of Newcastle or to the Town of Newcastle in any other Act,
regulation, by-law, resolution, agreement or other document to be references to The
Corporation of the Municipality of Clarington and to the Municipality of Clarington
respectively.
