THAT Report WD-16-89 be received; and 2 . THAT Council amend By-law 79-1 to provide that : I a) No person shall park a COMMERCIAL VEHICLE which exceeds 2 . 6 metres in width or 7 metres in length or having a vehicle weight in excess of 5000 kilograms on any highway, except in an industrial area, unless such vehicle is actually engaged in the loading or unloading of goods , wares , merchandise or passengers to adjacent premises. b) Any person who contravenes the above provision shall be liable upon conviction thereof to a fine of thirty ($30 . 00) dollars for each offence. and the Region be asked to sign their roads in the Town of Newcastle accordingly; OR 3 . THAT the Region be asked to sign their roads in the Town of Newcastle to provide for the three hour parking limit only; and 4. THAT a copy of this report be forwarded to Mr. W. A. Twelvetrees , Commissioner of Works , Region of Durham, and that he also be advised of Council ' s decision on this matter. . . . 2 - I . j Page 2 WD-16--89 1 . 0 ATTACHMENTS No. l : Letter dated November 28, 1988, from Mr. C. T. , Regional Clerk. 2 . 0 BACKGROUND 2 . 1 At a regular meeting of Council held on Monday, December 19, 1988, Council passed the following Resolution: "THAT the correspondence dated November 28, 1988, from Mr. C . W. Lundy, A.M. C . T. , Regional Clerk, regarding Cost Sharing of Signing Major Roads Entering Municipalities to Advise of Heavy Vehicle Parking Prohibition on Residential Streets and General Three-Hour Maximum Parking Restriction be received and referred to the Director of Public Works for a review and a subsequent report to be presented to the General Purpose and Administration Committee at the meeting scheduled to be held January 9, 1989. 11 3 . 0 REVIEW AND COMMENT 3 . 1 Section 5( i) of the Town of Newcastle By--law No. 79-1 reads : "No person shall on any highway park any vehicle for a period longer than three(3) hours except where designated signs have been erected in accordance with this by-law stating otherwise" 3 . 2 The Town of Newcastle does-not have a By-law to prohibit the parking of commercial vehicles on streets except in industrial areas . 3 . 3 There are six(G) locations where Regional Roads enter the Town of Newcastle. 3 Page 3 WD-16-89 4. 0 RECOMMENDATION 4. 1 Since Council has not discussed the passing of a By-law to prohibit the parking of commercial vehicles on streets except in industrial area, my recommendation is "either/or" . 4. 2 It is therefore recommended; 1 . THAT Report WD-16-89 be received; and 2 . THAT the Region of Durham be requested to sign the Regional Roads entering the Town of Newcastle to provide for the prohibition of parking on any highway for a period longer than three hours except where designated signs have been erected otherwise in accordance with By-law 79-1 ; and 4 . THAT a copy of this report be forwarded to Mr. W. A. Twelvetrees , Commissioner of Works , Region of Durham, and that he also be advised of Council ' s decision on this matter. Streets and General Three- Hour Maximum Parkin Restriction Regional onal Ge aerk Mrs. Barrie, the Works Committee of Regional Council considered the above matter and at a meeting held on November 16, 1988 Council adopted the following amended recommendations of the Committee: "i ) THAT the City of Oshawa be advised that: a) The Region will , during 1989, erect and maintain signs on major Regional roads entering the City of Oshawa, advising motorists of the heavy vehicle parking prohibition and the general three-hour parking restrictions ; and b) THAT, in the interest of uniformity, the matter of an increased fine for parking heavy vehicles where prohibited, will be discussed with all area municipalities at a future meeting of the Regional Traffic Advisory Committee. ii ) THAT the other area municipalities within the Region be forwarded a copy of Report #247-88 of the -- -- ---. Commissioner of Works ; and rU iii ) THAT the other area municipalities be advised of the availability of the program to their municipality and requested to reply prior to consideration of the 1989 budget."
