SUBJECT: CERTIFICATE OF COMPLETION
FOR PHASE 1 OF COURTICE HEIGHTS NORTH
PLAN 1OM-772
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following;
1. THAT this report be received; and
i
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Completion' for Phase 1 of Courtice Heights North,
Plan 1OM-772; and
ii
3. THAT a copy of this report be sent to Mr. Wm. Manson, c/o WDM Consultants,
20 Clematis Road, Willowdale, Ontario, M2J 4X2 and to Mr. N. Mensink,
G.M. Sernas & Associates Ltd. , 185 Brock Street North, Suite 207,
Whitby, Ontario, L1N 4H3.

REPORT
1.0 BACKGROUND
1.1 The Town of Newcastle has entered into a Subdivision Agreement with
Claret Investments Ltd. and Rexgate Holdings Ltd. to develop lands
in the north-west quadrant of the Nash Road and Trulls Road
Intersection (see Attachment No.1) .
1.2 The development of these lands was scheduled to be phased, and in March
of 1986 Phase 1 of Courtice Heights North, Plan 1OM-772 was authorized
to commence the construction of the works.

1.3 These works are defined as:
1. Storm sewers and appurtenances
2. Roadways (including boulevard works)
3. Street lights
1.4 The developer has completed all these works and his consultant has
requested that these works be placed on a two-year maintenance period
in accordance with the Subdivision Agreement (Section 5.23) , commencing
on November 1, 1987 (see Attachment N0.2) .
1.5 In order to deal with this request Section 5.22 and 5.23 of the
Subdivision Agreement must be satisfied and they read as follows:
5.22 REQUIREMENTS FOR CERTIFICATE OF COMPLETION
The owner agrees that the construction and installation of any of the
Works shall not be deemed to be completed for the purposes of this
Agreement until the Director has provided the Owner with written confirmation
thereof, referred to herein as a "Certificate of Completion". In
addition to any other requirements contained herein, no Certificate of
Completion shall be issued until:
1) Such of the Works authorized by the Authorization to Commence Works
for which a Certificate of Completion is required, have been
inspected by the Director, and the Town Council has approved the
written report of the Director that such Works have been constructed
and installed in accordance with the latest version of the Engineering
Drawings approved by the Director; and
2) The Town is satisfied that, in respect of the construction and
installation of all of the Works authorized by such Authorization
to commence works, there are no outstanding claims relating to such Works.
5.23 PERIOD OF REQUIRED MAINTENANCE OF WORDS
The Owner shall from the date of the issuance of Certificate of
Completion maintain all of the Works covered by such Certificate of
Completion for a period to two (2) years.

1.6 Public Works Staff have inspected these works and have found them to be
constructed satisfactorily and in accordance with the approved
engineering drawings. In addition, there are no outstanding claims which
relate to these works.
2.0 RECOMMENDATION
2.1 It is, therefore, recommended that the Director of Public Works be
authorized to issue a "Certificate of Completion" for Phase 1 of
Courtice Heights North, Plan 10M-772, dated November 1, 1987.

OUR PROJECT NO. 7840
We certify herein that all municipal servicing as required by the
subdivision agreement and the approved engineering drawings for the
above noted development have been completed as of November 1 , 1987.
We therefore request that the two ( 2) year maintenance period commence
effective November 1, 1987 and terminate October 31 , 1989 subject to
the requisite inspections.
