CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW'
ROADWAYS AND STORM SEWER SYSTEM
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-93-90 be received;
2 . THAT the Director of Public Works be authorized to issue a
"Certificate of Acceptance' for the roads, storm drainage system
and street lighting works constructed within Plan 1OM-794; and
3. THAT Council approve the by-law attached to this report
(WD-93-90) assuming the streets within Plan 1OM-794, as public
highways .

2.0 BACKGROUND
2 . 1 The Town entered into a subdivision agreement registered on title
June 15, 1987, with Kiddicorp Investments Limited to develop lands
by plan of subdivision, located in Bowmanville and described as
Plan 1OM-794 (see Attachment No. 1) . The agreement required the
developer to construct all roadworks including hot-mix paving, curb
and gutter, sidewalks, boulevard sodding and street trees, the
storm sewer including all appurtenances and street lighting works.
2 .2 All of the Works were completed and a 'Certificate of Completion'
was issued dated October 1, 1989 . The Works were placed on a
one year maintenance period which expired on October 1, 1990.
These Works were subsequently re-inspected and were found to be
satisfactory.
2 . 3 It is now appropriate to issue a 'Certificate of Acceptance' dated
October 1, 1990, for these Works, thereby accepting ownership of
the roads, storm drainage system and street lights . The
subdivision agreement provides for this certificate to be issued
by the Director of Public Works, subject to the approval of
Council.
2 .4 Further to the issuance of a 'Certificate of Acceptance' , a by-
law is required to permit the Town to assume all the streets within
Plan 1OM-794 .
3.0 RECOMMENDATION
3. 1 It is, therefore, recommended that the Director of Public Works be
authorized to issue a 'Certificate of Acceptance' for the roads,
storm drainage system and street lights within Plan 1OM-794 and
that Council approve the by-law attached to this report
(WD-93-90) assuming the streets within Plan 1OM-794 .

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 90-
Being a By-Law to assume certain streets within the Town
of Newcastle as public highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follow:
1. THAT the streets and street widening blocks described in
Registered Plan 1OM-794 (described in Schedule "A" attached
hereto and forming part of this By-Law) all being in the Town
of Newcastle, in the Regional Municipality of Durham, are hereby
accepted by the Corporation of the Town of Newcastle as public highways,
and assumed by the said Corporation for public use
2. THAT the Clerk be authorized to apply to the Land Registry
Office to have the Corporation of the Town of Newcastle shown
as the owner of the streets on Plan 1OM-794.
BY-LAW read a first time this day of 1990.
BY-LAW read a second time this day of 1990.
BY-LAW read a third and finally passed this day of 1990.
