RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-88-90 Addendum be received;
2 . THAT recommendation No.2 of Report WD-88-90 be rescinded;
3. THAT Condition No.6 of draft plan approval for Subdivision 18T-
84035 located on High Street in Bowmanville be amended to read:
6 (a) "THAT the applicant will pay the full costs ( 100%) of all
works (e.g. : intersection improvements, utility relocation,
ditch grading, sodding, entrance construction, etc. ) on High
Street and Meadowvale Boulevard which are required in
connection with this development with the exception of topsoil
and sodding of boulevards, street trees, driveways and hydro
distribution and 50% of the sidewalk, all on the east side of
High Street abutting the Town owned lots . "

6(b) "THAT the Town will use its best effort to ensure in entering
into agreements of sale of each of the four Town owned Lots
which will front onto High Street that a portion of the sale
price of each will be paid to the developer by the purchaser
so that each purchaser will pay one quarter of the Town's
share of the Town's allocated servicing costs. The Town's
allocated servicing costs are the actual cost of the
components of servicing High Street less the cost of topsoil
and sodding of boulevards, street trees, driveways and hydro
distribution and 50% of the sidewalk, all on the east side of
High Street abutting the Town owned lots . The Town's
allocated servicing costs are estimated to be $76,000; and

2.0 BACKGROUND
2 . 1 At a regular meeting of Council held on October 15, 1990, the
following resolution was passed:
"THAT Report WD-88-90 be tabled to allow for staff
to contact the Regional Municipality of Durham for
clarification of the Regional Policy pertaining to
cost sharing for servicing of Regionally-owned
land. "

2 .2 At a regular meeting of the General Purpose and Administration
Committee held on October 22, 1990, the following resolution was
passed:
"THAT the memorandum from T. Cannella, Manager of
Engineering, regarding cost sharing for servicing
of Town owned lots be referred to the General
Purpose and Administration Committee meeting
-scheduled to be held on November 5, 1990, to allow
sufficient time for a report to be prepared on this
matter. "
3 . 0 REVIEW AND BACKGROUND
3. 1 Region's 'Cost Sharing Policy' and Relevance to the Servicing of
the Town's Lots
The mechanics of the Region's 'Cost Sharing Policy' is outlined on
Attachment No. 1. It is clearly noted that this policy deals
exclusively with Regional Services (watermains and sanitary sewers)
only. This policy does not have a bearing on the servicing of the
Town's lots on High Street, nor does it have a financial
implication on Mr. Veltri. The purpose of the policy is to
facilitate the installation of oversized Regional Services in a
financially equitable manner with developers .
3 .2 Meeting Between Town Staff and Mr. Veltri
Public Works Staff met with Mr. Veltri and his consultant, Mr. G.
Karakokkinos of G. M. Sernas & Associates on October 12, 1990 to
discuss the cost sharing of the Town's lots on High Street.
Several scenarios were discussed with the objective of reducing Mr.
Veltri's financial burden for the Town's share of the works on High
Street. A cost sharing proposal in writing was later received from
Mr. G. Karakokkinos of G. M. Sernas & Associates dated October 12,
1990 (see Attachment No.2) .

3 . 3 Mr. Veltri's Cost Sharing Proposal

Town Staff reviewed Mr. Veltri's cost sharing proposal (See
Attachment No.2) but could not justify the acceptance of the terms
of this proposal as equitable to the Town from a financial
viewpoint.
3 .4 Town's Cost Sharing Proposal
Upon further review and consideration of Mr. Veltri's concerns,
staff prepared an alternative cost sharing proposal. Our proposal
considered the staging of the works, whereby Mr. Veltri would
construct all the 'Works ' specified in the engineer's estimate
dated September 24, 1990 (see Attachment No.3) with the exception
of topsoil and sodding of boulevards, street trees, driveways and
hydro distribution and 50% of the sidewalk, all on the east side
of High Street. The works excluded, would be constructed in the
future by the Town or the purchaser of the lots on the east side
of High Street when they are sold.
Should the Town's proposal be implemented, the up-front costs to
Mr. Veltri could be reduced by approximately $36,000 . Based on the
engineer's estimates the staging of these works would reduce Mr.
Veltri's up-front costs and reduce the future reimbursement from
the Town, from approximately $112,000 to $76,000. However, the
Town would be directly responsible for the deferred costs of
approximately $36,000 in the future. The details of the estimate
of cost is shown on Attachment No. 5 .
3 .5 Subsequent Meeting With Mr. Veltri
Another meeting was held with Mr. Veltri on October 29 , 1990, to
further discuss this matter. Mr. Veltri requested that the Town
consider the use of monies received through the development of Plan
18T-84035 to offset the Town's share of the 'Works' on High Street
such as:
a) Public Works portion of the Lot Levies
b) Parkland Contributions

This proposal was considered by staff and it was determined that
the use of Lot Levies or Parkland Contributions for the purpose of
development of Town owned lands would not be appropriate.
4.0 CONCLUSION AND RECOMMENDATIONS
4 . 1 In considering the various cost sharing proposals, it was concluded
that the most reasonable and equitable option was the Town's Cost
Sharing Proposal as outlined in Section 3 .4 . This proposal was
selected, since it facilitated Mr. Veltri's development of Plan
18T-84035 and reduced his up-front costs . In addition, the
proposal permits the Town to be selective in the timing for the
sale of the Town lots .

2.0 BACKGROUND
2 . 1 Plan of Subdivision 18T-84035 received draft plan approval on April
30, 1990 . Condition No. 6 of the draft plan approval states:
"That the applicant will bear the full cost ( 100%)

2 .2 Town Owned Lots on High Street
The Town owns four lots on the north side of High Street. Since the
Town will benefit from the construction of High Street and the
related services, the owner of the development, Mario_ Veltri has
asked the Town to agree to pay its fair share of the road and
servicing costs .
3.0 REVIEW AND COMMENT
3. 1 Town's Share
The lots owned by the Town and the Subdivision 18T-84035 are
illustrated on Attachment No.2 . The details of the 66st estimates
and cost sharing are illustrated on Attachment No.3. As noted, the
estimated cost for the Town's share is $111,937 . The Town's share
will be based on the items listed and will be based on actual costs
which will be determined upon completion of construction.
3.2 When Town to Pay Its Share
Mr. Veltri has asked that the Town pay its share within 30 days
after certification by the consulting engineer that the works have
been completed. His reasoning for this request is that once the
servicing is complete, the Town will have four marketable serviced
lots .
However, from the Town's viewpoint, the best time for the Town to
reimburse the developer for the Town's share of the servicing costs
is when the Town sells the four lots on High Street.
3 . 3 Estimated Completion Date
It is estimated that the servicing will be completed by November
30, 1990.
4.0 CONCLUSIONS AND RECOMMENDATIONS
4 . 1 Based on the above, it is recommended:

OUR PROJECT NO. 87155
With reference to the above-noted plan of subdivision and our
meeting of September 17, 1990, we are writing to confirm that
Condition No. 6 of the post circulation draft approval is onerous
to this development as the construction of High Street will not
only benefit the captioned subdivision but also the existing four
lots owned by the Town as noted on the attached sketch. Therefore,
we kindly request that this condition be amended to reflect the
following:
"That the applicant will bear the full cost (1000) of any
works (i.e. intersection improvements, utility relocation,
ditch grading, sodding, entrance construction etc. ) on High
Street and Meadowvale Boulevard which are necessitated as a
result of this development and that upon completion of same
and within 30 days thereafter certification by the consulting
engineer that the works have been completed, the Town will
reimburse the developer for 500 of the works fronting the
existing four lots. "
It is my understanding that during the 1990 fiscal year, Mario
Veltri, Larry Kotseff, Walter Evans, and Frank Wu had met and
negotiated an arrangement whereby they all agreed that Mr. Veltri
will purchase the four lots on the east side of High Street to be
comprised of eight individual units (link homes) and that the
estimated cost for construction for the frontage of these lots was
to be borne by Mr. Veltri, however, reflected in the purchase price
of the lots. Furthermore, correspondence from G.M. Sernas &
Associates Ltd. dated February 2 , 1990 and February 7 , 1990 to
Mr. Larry Taylor and Mr. Larry Kotseff of the Town of Newcastle

reflected the possibility of converting. the four Town lots from an
R-1 zoning to an R-2 zoning allowing seven forty foot single to act ,
as a buffer to the existing residence bn the east of High Street.
However, to date we have received no correspondence to this
proposal and as such the developer is anxious to finalize the plan
of subdivision 18T-84035 and deal with the four lots on a separate
issue.
It is therefore our position to proceed immediately With the
construction of the said subdivision including High Street and that
the four lots presently owned by the Town should not be conditional
to this development. As such, we kindly request that the Town
provide G.M. Sernas & Associates Ltd. the number of laterals
required to service the four lots and the Town's position to their +
share of construction of High Street.
It is our intention to sign the draft conditions as soon as the
Town is in agreement to amend Condition No. 6 as noted above and
furthermore it is the developer's position to proceed with
construction during the 1990 fiscal year. Therefore, we would
appreciate your assistance in expediting both our concerns noted
above and engineering drawings as soon as possible so we can
finalize the the subdivision agreement.
We are prepared to meet and discuss this matter so as to provide
additional information or to clarify any questions that you may
have.

At a meeting of Council on October 15, 1990, the following
Resolution #C-670-90 was passed:
"THAT Report WD-88-90 be received;
THAT Report WD-88-90 be tabled to allow for staff
to contact the Regional Municipality of Durham for
clarification of the Regional policy pertaining to
cost sharing for servicing of Regionally-owned
land; and
THAT a subsequent report be presented to the
General Purpose and Administration Committee
Meeting scheduled for October 22, 1990" .
AND Resolution #C-671-90 :
"THAT the foregoing Resolution#C-670-90 be amended
by adding the words "that appeared at both the
General Purpose and Administration Committee
Meeting held on October 1, 1990, and the Council
meeting held on October 15, 1990" after the word
"delegation" in the second paragraph.
In accordance with the above-noted resolution, Public Works
Staff have contacted the Region of Durham and have found
that the Region does not have a policy pertaining to the
cost sharing for the servicing of Regionally-owned lands .
The Region does have a 'Cost Sharing Policy' that deals with
development-`and the financing of the oversizing of Regional
services . This policy is administered in conjunction with
their standard subdivision agreement. Attached is a copy of
the Region's 'Cost Sharing Policy' .

Due to time constraints, we have reviewed the Region's `Cost
Sharing Policy' in a preliminary nature only. In addition,
we have discussed this policy with Regional staff and have
summarized our findings below:
1. The purpose, in principle, of the policy was to
facilitate in a financially equitable manner with
developers, for the oversizing and abutting costs of
Regional services such as watermains and sanitary
sewers .
2 . The policy deals exclusively with Regional watermains
and sanitary sewers and not Regional roads or storm
sewers.
3 . The ownership of the lands abutting or external to the
proposed Regional services is not a consideration in
the administration of this policy.
4. The policy defines the cost sharing apportionment
between the Region and the developer, for the
installation of Regional watermains and sanitary sewers
in conjunction with the servicing of a development. The
Region's costs for the oversizing of watermains and
sanitary sewers, would be included in the Region's
subdivision agreement with the developer.
5. In order to implement this the cost sharing policy, the
Region established a reserve fund. The purpose of this
reserve fund was to facilitate the payment to the
developer, of the Region's share of any oversizing
and/or abutting costs .
6 . In future, upon the development of the abutting lands
for which the Region has paid for oversizing or
abutting costs, the Region would recover their costs by
imposing frontage charges .
7 . This policy dictates to Regional staff under what
circumstances and to what limit, the Region will
reimburse the developer for the oversizing of Regional
watermains and sanitary sewers .

methodology and mechanics of the Region's 'Cost Sharing
Policy' .
Should Council wish to pursue this matter further or require
additional details, a detailed report may be prepared for
the next General Purpose and Administration Committee

services.
Minimum Size: shall be the size of a sanitary sewer and/or
a watermain of sufficient size, as determined
by the Region, to service a subdivision
provided that the minimum size shall not be
less than 200 millimetres in diameter for
sanitary sewers and 150 millimetres in
diameter for watermains.

watermains shall be the current cost as
determined by the Region, of constructing a
sanitary sewer and/or a watermain of
sufficient size to service the subdivision.

8) POLICY
i) Abuttinq Services
The cost for abutting services shall be shared between the
Region and the Subdivider on the following basis:
a) for the abutting services which are not required to service
the subdivision, the Region shall pay for 100 percent of the
cost.
b) For the abutting services which are required to service the
subdivision as well as lands outside of the limits of the
subdivision, the Subdivider shall pay for 50 percent of the
cost for the minimum size and the Region shall pay for the
balance of the cost.
c) For the abutting services which are required to service only
the subdivision and will not service any other lands outside
j the limits of the subdivision, the Subdivider shall pay for
100 percent of the cost.
11) Internal Services
The cost for internal services shall be shared between the
Region and the Subdivider on the following basis:
a) For internal services which are not required to service the
subdivision, the Region shall pay for 100 percent of the
cost,
b) For internal services which are required to service the
subdivision, the Subdivider Shall pay for 100 percent of the
cost for the minimum size and the Region shall pay for the
1 balance of the cost.

It i$ unfortunate that we were. unable to meet and discuss the
matter concerning the construction of High Street within plan of
subdivision 18T-84035 since the General Purposes and Administration
Committee meeting of October 1, '1990,
Our concern related to the above relates to the developer ):)eiirjg
responsible for 100; of any works.

it is our belief and understandihfq that the percentage of 10o'
as a result of Mr. Veltri purchas'ing the 4 lots owned by the Town.
T believe Mr. Veltri had documeilted certain costs to be deducted
from the price of the 4 lots, attributed to 50% construction of
High Street. Therefore, the 1,00% cost was attributed to the
developer on the premises that Mr. Veltri would have purchased the
4 lots from the Town . As you are aware this scenario has not and
may not occur. As such the Town� should treat this development of
High Street in accordance with p�' st situations which are sinilar.
it is our experience that in similar situations, the developer has
negotiated with the Public Works�, Departmoent that an abutting road
such as the one in question be constructed to a certain type of
cross-section reflecting 50% of the works. This is very difficult
to achieve if one wishes to be practical, therefore, in most
situations the developer ends up 6onstructing the road and services
in such a manner acceptable to the Town Public Works Department,
resulting to approximately 60 70 per cent of the total works .

As you can see from the above., the Town is being inconsistent with
the Town in this instance requesting 1004 of costs to be borne by
the developer. and a best effort to collect when and if the 4 are
ever sold. i
In order to expedite this situation, we wish to request that the
Town apply the same guidelines ::as used in the past, We recommend
the following for your consideration.
1. The developers (Veltri & San Limited) construct High Street in
the following manner:
a) all underground services as required
b) all ! of first year roadworks up to base asphalt
C) no top curb on east side
d) no sidewalk on east side which is required by the Town
e) no top course asphalt throughout �iigh Street
f) no boulevard treatment on east side
i. e, trees, sod, driveways, etc.
g) all items included in; year 2 works as attached herein.
2 . The Town 'to be responsible for the aforementioned as needed or
when the lots are sold.
3 . The Town to be responsible for the required storm sewer
connections needed for the '4- lots 30 days after certification
of the work by G.M. Sernas & Associates.
4 . The Town; to reimburse Veitri & son Limited the cost of
subdra,ins under the east curb line fronting the 4 lots and
that portion south of the 4 lots to Meadowview Boulevard when
the 4 lots are sold.
5 . The Town reimburse Velt,i & Son Limited 50% of the cost of all
granular material and base asphalt when the 4 lots are sold.
Conditions 4 and 5 are not to be on the best efforts basis but must
be enforced when lots are sold.
We trust the proposal provided is amiable to all parties, however,
we realize th4 Town staff will not be able to reach a decision
prior to the Council meeting being held Monday, October 15, 1990 .

Therefore, we are requesting that the matter be tabled allowing
both parties to reach a mutually agreed solution. We are
requesting that the matter be fabled for a period of 2 weeks and
that a meeting be held by the appropriate parties in the meantime
to resolve this issue.
