RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
I
1. THAT Report WD-85-90 be received;
2 . THAT Mr. Clare M. Hilsden, P. Eng. , Assistant District Engineer,
Port Hope District, Ministry of Transportation be advised that the
Town agrees to the transfer of the Highway 401 Service Road located
on the south side of the C.N.R. in Lots 33, 34, and 35, Concession
1, former Township of Clarke from Ministry to Town of Newcastle
jurisdiction;
3. THAT the assumption of the road be on the basis of the Ministry
paying the cost, to a maximum amount of $83,600, for the
improvement of the road by the Town, such improvement to include
ditching, placing of granular material and hot-mix paving;

4 . THAT the Town agrees to undertake continuing summer and winter
maintenance of the road, at the Ministry's expense, until the j
transfer of jurisdiction is completed; j

5. THAT the Mayor and Clerk be authorized to execute all documents
necessary to complete the transfer of jurisdiction; and
6 . THAT Mr. Clare M. Hilsden, P. Eng. ,, Mrs Ruth Hinkley, President of
the Wilmot Creek Homeowner's Association and Mr. David Rice, Pine
Ridge Developments be advised of Council's decision.

2.0 BACKGROUND
2 . 1 The Highway 401 Service Road was constructed by the Ministry to
provide access to properties on the south side of Highway 401 when
Highway 401 was constructed in the mid 19501s.
2 .2 The road now provides access for Ontario Hydro to their
transmission lines and to the Wilmot Creek development.
3.0 REVIEW AND COMMENT
3. 1 The Highway 401 Service Road (Service Road) is shown on the Town's
street name map as "a summer maintained" road. To the best of MY
knowledge, this road has not been ploughed during the winter
months .
3 .2 The Service Road provides a second access to the Wilmot Creek
Development which now has 655 homes and a population of about
1,115. At the present time the only fully maintained access to the
Wilmot Creek Development is located on the west side of the
development.

3.3 A development the size of Wilmot Creek should have two fully
maintained access routes.

3.4 Mr. Hilsden approached me some time ago to determine if I would be
prepared to recommend to Council that the jurisdiction of the
Service Road be transferred from the Ministry to the Town. I
advised him that I would, providing that the Ministry pay the cost
of improving the road to Town standards.
3.5 In my opinion the Town should assume jurisdiction of the Service
Road for the following reasons:
1. The Service Road does not function as
a Kings Highway.
2 . The Wilmot Creek Development should have
a second fully maintained access and the
responsibility for the maintenance of the
Service Road should be a local
responsibility.
4.0 RECOMMENDATIONS
4. 1 In view of the above, it is recommended:
a) THAT Mr. Clare M. Hilsden, P. Eng. , Assistant District
Engineer, Port Hope District, Ministry of Transportation be
advised that the Town agrees to the transfer of the Highway
401 Service Road located on the south side of the C.N.R. in ;
Lots 33, 34, and 35, Concession 1, former Township of Clarke
from Ministry to Town of Newcastle jurisdiction;

Dear Sir: Re: Highway #401 Service Road - Wilmot Creek
Further to your letter of June 21, 1990 and our more recent site visit with
your staff, this is to advise that we have approval of funds for the
improvements proposed in your letter, for a maximum of $83,600. We would,
however, suggest that H.L.-4 would more appropriately suffice for paving of
this road.
On the basis of this understanding, would you kindly present to Council the
proposal for improvements to be undertaken this year by the Town of
Newcastle on the Ministry ' s behalf , and seek a resolution agreeing to
transfer of the road from Ministry to Town of Newcastle jurisdiction upon
completion of -the work. We would also ask that during the period that
transfer procedures are in process, that the Town undertake continuing
summer and winter maintenance at the Ministry's expense.
I understand that you have a paving contract in place at a very reasonable
unit price, and we trust the work can be accomplished by the Fall of this
year to utilize your contract and available Ministry funds.
We would appreciate a call to advise as to when Council will address this
issue. As I will be on vacation for three weeks in August, please ask for
Mr. Joe Kernaghan, our District: Engineer, if I am not available. Thank you
for your cooperation.
