HomeMy WebLinkAboutWD-82-90 TOWN OF NEWCASTLE REPORT File # - r Res. # By-Law # METING GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: SEPTEMBER 4,1990 REPORT #: WD-82-90 FILE #: &J$,ECT: REQUEST FOR CLOSURE AND 'CONVEYANCE OF PART OF PORTER STREET AND PART OF WINNSTANLEY STREET ACCORDING TO PORTER AND BRADSHAW PLAN LOT 9, CONCESSION 1, FORMER TOWN OF BOWMANVILLE PARTS 2 AND 4, PLAN 1OR-3726 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-82-90 be received; 2 . THAT staff be authorized to advertise a public hearing required by the Municipal Act for the closure and conveyance of the unopened part of Porter Street and part of Winnstanley Street described as Parts 2 and 4 on Plan 1OR-3726; 3. THAT if following such Hearing, Council decides to close and authorize the conveyance of the subject road allowance to 621182 Ontario Ltd. , that Council defer the passing of the necessary by- law until the Town has received compensation for the conveyance established at a value of $125,000 per acre plus all associated costs. 4 . THAT the applicant execute an Indemnity Agreement with the Town satisfactory to the Town's solicitor prior to the passing of the necessary by-law. 5. THAT Mr. Fari Farivarz, Liza Developments Corp. (621182 Ontario Ltd) be advised of Council's decision. lCU . . .2 REPORT NO. : WD-82-90 PAGE 2 REPORT 1.0 ATTACHMENTS No. l: Key Map 2.0 BACKGROUND 2. 1 621182 Ontario Ltd. (Liza Developments) own Plan of Subdivision 18T-89013, which is located at the north/west corner of Concession Street and Mearns Avenue in Bowmanville. 2 .2 Porter Street and Winnstanley Street divide properties being developed by Ashdale Capital Corporation and Liza Developments Ltd. The developers have requested the closure and conveyance of these portions of Winnstanley and Porter Streets shown as Parts 2, 3, 4, and 5 on Plan 1OR-3726 and have agreed to the division of lands as shown on Attachment No. l. Resolution #GPA-495-90 authorized the closure and conveyance of Parts 3 and 5 and the by-law will be read at the Council meeting of September 10, 1990. 2 .3 Parts 2 and 4 are the subject of this report, and Liza Developments, being the abutting property owners, have expressed their desire to acquire Parts 2 and 4 at the appraised value of $125,000 per acre. 2 .4 The total area of Parts 2 and 4, Plan 1OR-3726 is 0. 088 ha (0.217 acres) . Lands considered public roadway to remain as roadway is 0 .070 ha (0 . 173 acres) . Lands considered public roadway to be used for future development is 0. 018 ha (0. 044 acres) . 3.0 COMPENSATION 3. 1 The total area of land considered to be public roadway to be closed and severed for future development by Liza developments Ltd. is 0.018 ha (0.044 acres) . . . .3 ID REPORT NO. : WD-82-90 PAGE 3 The appraised value of land was established at $125,000 per acre as at January 29, 1990.
