Res. # (((' — - -�• By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION MEETING DATE: SEPTEMBER 4, 1990 REPORT #: WD-77-90 FILE #: SUB.ECT: DEDICATION OF BLOCK 43, PLAN 1OM-782 AS PUBLIC ROAD ALLOWANCE ROYAL PINES COURT, BOWMANVILLE RECOMMENDATIONS: It is respectfully recommended, that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-77-90 be received; 2 . THAT a by-law be passed to dedicate Block 43 of Plan 1OR-782 as public road allowance and that the Mayor and Clerk be authorized to execute said by-law; and 3. THAT a copy of this report be forwarded to Mr. George Armoyan, Secretary and Chief Operating Officer, Nor-Arm Developments Inc. --------------------------------------------------------------------- REPORT 1.0 ATTACHMENT No. l: Letter dated August 8, 1990, from Mr. George Arnoyan. No.2 : Key Map No.3: By-law 2.0 BACKGROUND 2 . 1 Attached is a copy of a letter from Mr. George Armoyan of Nor-Arm Developments Inc . (Attachment No. 1) , requesting the lifting of a 0. 3 metre reserve described as Block 43 of Plan 1OM-782 . The purpose of Mr. Armoyan's request is to provide clear and unobstructed access to his new subdidivision to the west. REPORT NO. : WD-77-90 PAGE 2 2.2 The property in question is located west of Mearn's Avenue north of Highway No.2 in Bowmanville (Attachment No.2) . 2.3 As the lands immediately west of this 0. 3 m reserve are now being developed through a subdivision agreement between Nor-Arm Developments Inc. and the Corporation of the Town of Newcastle, it is appropriate that the 0.3 m reserve be lifted. 3.0 RECOMMENDATION 3. 1 It is, therefore, recommended that a by-law be passed to dedicating Block 43 of Plan 1OM-782 as public road allowance and that the Mayor and Clerk be authorized to execute the said by-law. As you are award, Nor-Arm Developments Inc. is the owner of the adjacent: lands (hots 1 to 10, Royal Pines CourL, Registered Plan 1OM- 837 ) . As the Town of Newcastle has assumed the said subdivision, we would ask that the Town now dedicate the 0 . 3 metre reserve (Block 43 ) on Plan 1OM--782 as public highway. Accordingly, we request that the appropriate oy-law be prepared to dedicate that reserve. D AUG. 1990 SITE ATTACHMENT NO. 2 KEY MAP WD-77-90 1 I CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 90- Being a by-law to dedicate certain lands as a public highway in the Town of Newcastle, Part Lot 9, Concession 1, former Town of Bowmanville. I I BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE BY THE COUNCIL THEREOF AS FOLLOWS: II' The following land is hereby established as a public highway know as Royal Pines Court in the former Town of Bowmanville, now in the Town of Newcastle. The said land hereby established as a public highway is described as follows: ALL AND SINGULAR THAT certain P arcel or tract of land and premises, situate, lying and being in the Town of Newcastle, in the Regional Municipality of Durham, located in Part of Lot 9 of Concession I, of the former Town of Bowmanville, now within the limits of the Town of Newcastle, Regional Municipality of Durham, more particularly described as Block 43 on Registered Reference Plan 1OM-782, deposited in the Land registry Office for the Registry Division of Newcastle (No.10) , on September 5, 1986 (Instrument No. 5001) .
