SUB.ECT: CONVEYANCE OF TOWN OWNED LAND TO MINISTRY OF TRANSPORTATION
OF ONTARIO
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-76-90 be received;
2 . THAT the Town sell the parcel of land described as Parts 3 and 4
on Plan 1OR-3101 (see Attachment No. l) to the Ministry of
Transportation of Ontario for the sum of fifty dollars ($50.00) ;
3 . THAT the Town sell 'Temporary Limited Interest' for the parcel of
land described as Part 2 on Plan 1OR-3101 (see Attachment No. l) to
the Ministry of Transportation of Ontario for a period of two (2)
years commencing August 1, 1991, and terminating July 31, 1993, for
the sum of fifty dollars ($50 .00) ;
4. THAT the Mayor and Clerk be authorized to execute all documents
necessary to complete the transactions;
5 . THAT the Town solicitor be directed to take all necessary action
to complete the transactions; and
6 . THAT Mr. Wilf Sippola of 110 Right of Way Services (representing
the Ministry of Transportation of Ontario) be advised of Council's

2.0 BACKGROUND
2 . 1 The Ministry of Transportation of Ontario is undertaking the
reconstruction of Highway #2 to Newcastle Village in 1991-1992.
2 .2 In conjunction with this reconstruction, the Ministry of
Transportation is acquiring adjacent lands where required.
3.0 REVIEW AND COMMENT
3. 1 The reconstruction work described includes the replacement of the
existing culvert/bridge on Highway No.2 at the west limit of
Newcastle Village.
3.2 Additional lands are required by the Ministry to accommodate the
improved, wider structure, as well as to provide a temporary
working area.
3 . 3 Parts 3 and 4 on Plan 1OR-3101 comprise a total of approximately
0.05 acres to accommodate the larger replacement structure proposed
at the described location.
3.4 Part 2 on Plan 10R-3101 consists of approximately 0. 165 acres to
be used as working area only, for the period of August 1, 1991 to
July 31, 1993. This is termed a 'Temporary Limited Interest' by
the Ministry and is similar to a temporary easement.
3.5 Compensation is set at fifty dollars ($50.00) for each transaction,
in accordance with the Ministry's Guidelines.
3.6 The conveyance of the above-noted lands will not have an adverse
effect on adjacent Town owned lands .

4.0 RECOr1MENDATIONS
4. 1 THAT the Town sell the parcel of land described as Parts 3 and 4

land described as Part 2 on Plan 1OR-3101 to the Ministry of

dollars ($50. 00) ;

Dear Mr . Evans :
As discussed on July 12 , 1990 , I am enclosing copies of the
Ministry ' s Property Purchase Agreement and Licence Offer, together
with the relevant survey plan.
The Ministry has valued the property as conservation land at
$1000 per acre. The acquisition consists of 0 . 050 arcres and the
Temporary Limited Interest is based on 0 . 165 acres @ $1000 at 10/
per year for two years or $33 .00 rounded to $50 .00.
I understand that you cannot get these offers t'o Council before
September but if you have any questions in the mean time please
