By-Law s# MEETING: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: SEPTEMBER 4, 1990 REPORT #: WD-75-90 FILE #: SUBJECT: MARYLEAH COURT AND ANDELWOOD COURT PLAN 1OM-755 AND 1OM-763 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ROADWAYS AND STORM SEWER SYSTEM RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-75-90 be received; 2 . THAT the Director of Public Works be authorized to issue a "Certificate of Acceptance' for the roads, storm drainage system and street lighting constructed within Plan 1OM-755 and 1OM-763; and 3 . THAT Council approve the by-laws attached to Report WD-75-90 assuming the streets within Plan 1OM-755 and Plan 1OM-763 as public highways. --------------------------------------------------------------------- REPORT 1. 0 ATTACHMENTS No. l: Key Map Showing Location of Plan 1OM-755 and Plan 1OM-763 No.2 : By-law For 1OM-755 No.3: By-law for 1OM-763 : . .2 t i REPORT NO. : WD-75-90 PAGE 2 i 2 .0 BACKGROUND 2 . 1 The Town entered into a subdivision agreement registered on title g g March 16, 1984 with 542985 Ontario Limited (Van Andel and Gust) to develop lands by plan of subdivision, located in the former Township of Darlington, and described as Plan 1OM-755, (see Attachment No. l) . The agreement required the developer to construct all roadworks including hot-mix paving, granular shoulders, topsoiling and sodding of ditches, drainage works and street lighting. 2 .2 A subsequent agreement was registered on title April 22, 1985, for Plan 1OM-763. There were no works associated with this plan, but Block 7 (road widening) and Block 8 (0. 3 m reserve) were to be conveyed to the Town (completed May 8, 1985, Instrument Number 2122) . 2 .3 All of the works were completed and a 'Certificate of Completion' was issued dated September 30, 1987 . The works were placed on a two year maintenance period which expired on September 3, 1989 . These works were subsequently re-inspected and were found to be satisfactory. 2 .4 It is now appropriate to issue a 'Certificate of Acceptance' dated September 10, 1990, for these works, thereby accepting ownership of the roads, storm drainage system and street lights. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2.5 Further to the issuance of a 'Certificate of Acceptance' , a by- law is required to permit the Town to assume all the streets within Plan 1OM-755 and Plan 1OM-763. (l I Z . . .3 REPORT WD. : WD-75-90 PAGE 3 3.0 RECOMMENDATION 3. 1 It is, therefore, recommended that the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system and street lights within Plan 1OM-755 and Plan 1OM-763 and that Council approve the by-laws attached to Report WD-75-90 assuming the streets within Plan 1OM-755 and Plan 1OM-763 . KEY WO-75-90 a 014 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 90- Being a By-Law to assume certain streets within the Town of Newcastle as public highways in the Town of Newcastle. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follow: 1. THAT the streets and street widening blocks described in Registered Plan 1OM-755 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use. 2. THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-755. BY-LAW read a first time this day of 1990. BY-LAW read a second time this day of 1990.
