2.0 BACKGROUND
2 . 1 At a regular meeting held on December 11, 1989, Council passed
Resolution #C-820-89:
"THAT the correspondence dated November 29, 1989,
from Richard L. Furlong of Furlong, Collin,
Manderson & Gunding, requesting an encroachment
agreement with the Town of Newcastle, for the
property located at 23 Second Street, Bowmanville,
be received; and
THAT the correspondence be referred to the Public
Works Department for review and a report to be
submitted to the General Purpose and Administration
Committee; and
THAT Richard L. Furlong be advised of Council's
decision.
3.0 REVIEW AND COMMENT
3 . 1 The subject dwelling is located at 23 Second Street, Bowmanville,
and encroaches by a distance of 0. 01 m (0 .04 feet) (Attachment
No.2) .
3 .2 There are no plans to reconstruct Second Street in the five year
forecast. At this time the Public Works Department does not
anticipate any changes to the existing conditions on Second Street
and have no plans to utilize the lands on which the encroachment
exists . The road allowance is 15 .24 m (50 .0 feet) wide and the
pavement is 6 . 1 m (20 .0 feet) wide.
4.0 CONCLUSIONS AND RECOMMENDATIONS
4 . 1 From the above it can be concluded that the encroachment will not
interfere with any future plans for reconstruction of Second
Street.

Dear Sir:
Re: DeJong estate sale to Sellers
Part Lot 12, Block G, Lockhart and Simpson Plan
(formerly in the Town of Bowmanville)
23 Second Street, Bowmanville
Please find enclosed herewith survey of lands presently owned by the Estate
of Freerk De Jong. t
The municipal address is 23 Second Street, Bowmanville (Newcastle) it would '
appear that the dwelling on the said lands encroaches onto Second Street and i
from the information that I have been given it would appear that the encroachment !
has existed for many many years.
Accordingly I request from the Town of Newcastle an encrochment agreement
permitting the encroachment to continue. Some municipalities prefer a letter
of tolerance and I would be satified with either document. If you wish our offices
to prepare the same so that there will be no costs to the Town of Newcastle please
advise and I will gladly prepare it.

Yours very truly,
