HomeMy WebLinkAboutWD-65-90 TOWN OF NEWCASTLE File # REPORT /e Res. # By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: JULY 9, 1990 REPORT #: WD-65-90 FILE #: SJ$,ECT: REQUEST FOR ENCROACHMENT 23 SECOND STREET, BOWMANVILLE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-65-90 be received; 2 . THAT Mr. Richard L. Furlong be advised that Council will pass a by- law to permit a 0 .01 m (0.04 feet) encroachment onto 23 Second Street, Bowmanville, upon receipt of a registered reference plan illustrating the encroachment. 3 . THAT the by-law be registered on title. 4 . THAT the applicant pay the cost of registering the by-law on title; and 5. THAT a copy of Report WD-65-90 be frowarded to. Mr. Richard L. Furlong Attachment No. 2 : Key Map _ - - .2 REPORT NO. : WD-65-90 PAGE 2 2.0 BACKGROUND 2 . 1 At a regular meeting held on December 11, 1989, Council passed Resolution #C-820-89: "THAT the correspondence dated November 29, 1989, from Richard L. Furlong of Furlong, Collin, Manderson & Gunding, requesting an encroachment agreement with the Town of Newcastle, for the property located at 23 Second Street, Bowmanville, be received; and THAT the correspondence be referred to the Public Works Department for review and a report to be submitted to the General Purpose and Administration Committee; and THAT Richard L. Furlong be advised of Council's decision. 3.0 REVIEW AND COMMENT 3 . 1 The subject dwelling is located at 23 Second Street, Bowmanville, and encroaches by a distance of 0. 01 m (0 .04 feet) (Attachment No.2) . 3 .2 There are no plans to reconstruct Second Street in the five year forecast. At this time the Public Works Department does not anticipate any changes to the existing conditions on Second Street and have no plans to utilize the lands on which the encroachment exists . The road allowance is 15 .24 m (50 .0 feet) wide and the pavement is 6 . 1 m (20 .0 feet) wide. 4.0 CONCLUSIONS AND RECOMMENDATIONS 4 . 1 From the above it can be concluded that the encroachment will not interfere with any future plans for reconstruction of Second Street. . . . 3 f 4 REPORT NO. : WD-65-90 PAGE 3 4 .2 That Mr. Richard L. Accordingly I request from the Town of Newcastle an encrochment agreement permitting the encroachment to continue. Some municipalities prefer a letter of tolerance and I would be satified with either document.
