REQUEST FOR ENCROACHMENT MILL STREET, NEWTONVILLE PART 7, PLAN 1OR-1209 RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-64-90 be received; 2 . THAT Mr. W. Kay Lycett be advised that Council will pass a by-law to permit a 1. 10 m (3 . 61 feet) encroachment onto Part 7, Plan 1OR- 1209, Mill Street, Newtonville, upon receipt of a registered reference plan illustrating the encroachment. 3 . THAT the by-law be registered on title; 4 . THAT the applicant pay the cost of registering the by-law on title; and 5. THAT a copy of Report WD-64-90 fe forwarded to Mr. Kay W. Kay Lycett Attachment No. 2 : Key Map 2.0 BACKGROUND 2 . 1 At a regular meeting held on October 30, 1989, Council passed Resolution #C-713-89: "THAT the correspondence dated October 18, 1989, from W. Kay Lycett, requesting that the Town of Newcastle execute a by-law authorizing an encroachment of Part of Lot 7, Plan 1OR-1209 , be received; THAT the correspondence be referred to the Public Works Department for review and subsequent report to the General Purpose and Administration Committee; and THAT W. Kay Lycett be advised of Council's decision. 3.0 REVIEW AND COMMENT 3. 1 The dwelling on this property encroaches onto Mill Street, Newtonville. The encroachment is illustrated on Attachment No.2 . 3 .2 Mill Street is immediately adjacent to Highway No.2 . At this time the Pubic Works Department has no plans to utilize the lands on which the encroachment occurs . 4.0 CONCLUSIONS AND RECOMMENDATIONS 4 . 1 From the above it can be concluded that the encroachment will not interfere with any future plans for reconstruction or development. . . .3 � o � U i REPORT NO. : WD-64-90 PAGE 3 i 4 .2 It is, therefore, recommended that Mr. W. I_E GLERK,`G DEI1AWI VENT Re: Inez Mae Boughen Parts of Lot 8, Concession 2, Clarke in Newtonville designated as Parts 2, 3, 5 & 6, and encroachment of Part 7., Plan 1OR-1209 I am the solicitor for Inez Mae Boughen who is.the owner of a house and garage situate upon the lands above described as shown on a reference plan of survey no. 1OR 71209. You will note that the house in question being a one storey frame dwelling which undoubtedly has existed for many years, encroaches on the road allowance between Concessions 1 and 2 to the extent of that portion of the road allowance now desigrilrtoed as Part 7 on the same plan. Mrs. Boughen is in the process of selling and conveying. this property and we have been required to obtain from your municipality a by-law to the extent that the Corporation has no objection to the extent of this encroachment on these lands for the'term of the life of the building. Accordingly, by this letter we make application for passage of such a by-law and/or resolution as the case may be for presentation to the purchaser's solicitor at. the earliest possible date and we do have a tentative closing date of December 31st, 1989.
