THAT Report WD-56-90 be received for information. -------------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. l: Key Map No.2 : Correspondence dated May 29, 1990, from Mr. Edmond Vanhaverbeke. 2.0 BACKGROUND 2 . 1 At a regular meeting of Council held on May 28, 1990, Resolution #C-388-90 was passed: "THAT the issue of construction of the Edward Street Bridge as contained in the Subdivision Agreement entered into by the developer, be referred to staff for preparation of a report to be considered by the General Purpose and Administration Committee. . . .2 1 .� U REPORT NO. : WD-56-90 PAGE 2 2 .2 The Town's Official Plan as it relates to Newcastle Village and the development of the west quandrant of Newcastle Village, outlines a link with the downtown core by the extension of Edward Street. In order to facilitate the extension of Edward Street a bridge was required to cross Foster Creek. 2 .3 The Town of Newcastle entered into a subdivision agreement with Foster Creek Developments for the development of Plan 18T-84011 and 18T-85030 (refer to Attachment #1) . The development agreement was registered on title by the Town on June 4, 1987 and the construction of the subdivision commenced. 2 .4 The Development Agreement required the developer to satisfy two conditions with respect to the creek crossing: 1. The developer was required to construct a bridge crossing Foster Creek as part of the construction of Phase III of the development. 2 . The developer was required to provide a performance guarantee in the form, of an irrevocable letter of credit for the total cost of the creek crossing. 3.0 CRITICAL PATH FOR CONSTRUCTION 3. 1 The total cost for the construction of the creek crossing is estimated at $740,000. The Town holds a Performance Guarantee in excess of the full value of the creek crossing. 3.2 The developer's engineering consultant has obtained written approval from the Ministry of Natural Resources and the Ganaraska Conservation Authority, however approval from the Ministry of Transportation is outstanding. Engineering drawings have been submitted to the Ministry of Transportation and we anticipate approval of the drawings. 3 . 3 The critical path for the construction of the bridge is to obtain the approval of the Ministry of Transportation (structural) and for the developer to tender and award the project. � (1 ,71 n REPORT NO. : WD-56-90 PAGE 3 4.0 STATUS OF CONSTRUCTION 4 . 1 In order to expedite the construction this summer within the given timeframe, the developer's consultant is tendering this project simultaneously with their submission of the engineering drawings to the Ministry of Transportation. 4 .2 Upon approval from the Ministry of Transportation, the contract for the bridge construction will be awarded by the developer's consultant. 5.0 SUMMARY 5 . 1 It is anticipated that approval from the Ministry of Transportation will be forthcoming shortly and that construction of the bridge will be completed this summer. 5 .2 Town staff have discussed the urgency for the construction of the bridge with the developer and we have recently received correspondence from the developer expressing his intentions to proceed with the construction of the bridge (refer to Attachment #2) . 6.0 RECOMMENDATIONS 6 . 1 It is, therefore, recommended that this report be received for information. I would like to point out that it is our intention to have the bridge constructed as soon as all approvals are received. As you are aware we have Letters of Credit guaranteeing construction. We are and always have been committed to the construction and it is only in our best interest to have it done as soon as possible, prior to any possible increase in construction costs. I have just last week reaffirmed this to our engineer, Mr. Devon Biddle and he will be making every effort possible to facilitate construction this summer.
