MARY NOVAK FOR STREET LIGHTING ON PEBBLESTONE ROAD RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-51-90 be received; 2 . THAT Mrs. Mary Novak be advised that since there is no warrant for the installation of a street light on Pebblestone Road in front of her house, her request is denied; and 3 . THAT Mrs . Mary Novak be advised of Council's decision and that a copy of this report be forwarded to Mrs . No.2 : By-law 84-21: Policy for Street Lighting . . .2 i i I REPORT NO. : WD-51-90 PAGE 2 2.0 BACKGROUND 2 . 1 At a meeting held on November 27, 1989, Council passed Resolution #C-774-89 : "THAT the correspondence dated November 14, 1989, from Mrs . Mary Novak requesting street lighting on Pebblestone Road be received and referred to the Director of Public Works for the presentation of a subsequent report to the General Purpose and Administration Committee; and THAT Mrs . Mary Novak be advised of Council's decision. " 3.0 REVIEW AND COMMENT 3 . 1 In Mrs . Novak's correspondence of November 14, 1989, (Attachment No. l) Mrs . Novak requests that a street light be placed in front of her residence on Pebblestone Road. Mrs . Novak refers to problems with illegal dumping of debris on Pebblestone Road and vandalism in the area as reasons for the request. 3.2 The criteria and warrants for street lighting are covered under Town By-law 84-21 (Attachment No.2) . Mrs . Novak's home is on Pebblestone Road where there is no warrant for street lights under the terms of the By-law. 3. 3 If a person requests a street light in an area where lighting is not warranted, a light can be installed, provided that the applicant pays all costs for installation, maintenance and electricity. . . .3 102- 0 REPORT NO. : WD-51-90 PAGE 3 4.0 RECOMMENDATIONS 4 . 1 THAT Mrs . The letter is quite self explanatory, however events leading up to the request for some street lights are not . The small stretch of road & ditch from the corner of Courtice and Pebblestone road up to 1712 Pebblestone Rd. are a continuous garbage dumping ground, by continuous I literally mean everyday if not every other day. My several requests to the public works department to clean up the debris have been ignored including the most recent personal conversation I had with the undersigned on the letter Brent Mavin, who gave me his assurance it would be done over a month ago . On November 3rd I spoke to Walter Evans requesting the same clean up and giving him a short history of the problem, in which he replied t should write this letter to the Town Clerk, so it will go to council and be received. He also felt that there were lots of dark corners in the Town of Newcastle which in my opinion was not much of a solution to the problem, however, lie did say he would clean up the ditches and although this is good I don ' t believe it is the taxpayers best interest to come out to a specific spot to have to spend money everyday or even once a wee}; to clean a ditch . My father and I live on Pebblestone Rd. and we alone pay approximately $175 . 00 weekly in taxes . We feel a street light would be a more effective use of a portion off our taxes . A further twist to the problem is vandalism. In the recent year or two, I have personally been vandalized several times , one j incident costing me several hundred dollars out of my pocket because we did the right thing and charged the individual with theft only to find it actually cost us more than it did the convicted, second similar offense criminal . These and most other incidents may have been prevented if street lighting were in place . The police have been called to the area numerous times and these incidents (as well as costing money to the taxpayer) in the opinion � of some of Durham ' s finest police officers could be prevented with proper lighting . i ATTACHMENT NO, I X022 -2- Possibly the most serious probi�_>m facing people on Pebblestone Rd . and people travelling this road is the hig}1 risk of accidents that are possible . This dumping situation has been allowed for so long, there seems to be no fear oL' being caught o.0 repercussions , consequently, frequently, they don' t ever bother to throw it in the ditch any more or drive in one of the driveways, they just dump it on the road. These have been reported to the police and even as recently as Monday November 13 , 1989 an officer had to remove debris from the road in order to prevent possible tragedy. The Town has approved a great deal of new development in the area and with this comes a greater influx of population & problems . With the greater tax dollars received provisions have to be made to solve some of these problems . This problem is very real & very serious and with all aspects considered, the street light seems to be the best solution to the problem. I have in writing asked Mr. Patterson to provide me with several points of information so that I may make my own calculuations of how tax money' s spent on this route as opposed to preventive solutions . To date November 14 , 1989 1 have not received this information and still await it. I was told at Town Hall at the Public Works department by Janet C. O'Neill, that Mr. Patterson was only authorized to give out this public information. I await his reply, meanwhile some information for Council . i NOV 3/89 - Spoke to Walter Evans he had a sofa picked up & garbage in ditch in front of my house . NOV 5/89 - SUNDAY - 2 men dangerous road hazard garbage on road-police report filed 2 men from Public Works came to clean it . I NOV 8/89 - Spoke to Glen Smith he picked up toilet in my ditch but again did not clean up debris in ditch across road . i NOV 9&10 . 89 - Cleaned u other side P of ditch & my ditch and cleared up most debris . NOV 13/89 - Called police, large table & wood parts dropped on road 'very dangerous " - policeman removed it & said he 'd call the Town Hall in morning to have it removed. I followed up at 8 : 45 A. THE CORPORATION OF' THE TOWN-OF NE14CAS'(aLE BY-LAW 84- 21 being a by-law to establish a policy with respect to criteria and warrants for street lighting within the Town of Newcastle, WHEREAS the Council of the Corporation of the Town of Newcastle deers it expedient to enact a policy with respect to the criteria and warrants for street lighting within the Town of IJewcastl„ ; AND WHEREAS the Corporation of the Town of Newcastle did, by Council Resolution NC-910-83, eancted December 12th, 1983, direct that thA criteria and warrants for illumination be estahlIshed by by-law; NOW THEREFORE DE IT ENACTED AS A 13Y-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS; POLICY I . It be the policy of the Corporation of the Town of Newcastle that the criteria and warrants for street lighting in the Town of Newcastle shall be in accordance with schedules detailed herein. SCHEDULE "A” A. GENERAL POLICIES FOR STREET LIGHTING: 1 . Where one or more of the following warrants is satisfied, the Town may consider the provision of street lighting on the initiative of Council as provided under the Local hiprovements Act. i P. The Town may consider the installation of street lights on Regional Roads or King's Highways or at the intersection of Town Roads and Regional Roads or King's Highways if sufficient warrants exist. I 3. Notwithstanding the provisions of this policy, street lighting requirements will continue to be imposed as part of development agreements and street lighting required external to new development (or which becomes deficient as a result of mew development) will be funded by incorporating' the additional Cost in the calculations of lot levies. i 4. The level and standard of illumination to be provided in a specific area will be calculated by the Director of Public Works in accordance with currently accepted practice. p P e, B. WARRANTS FOR STREET LIGHTING ON MAIN LINE ROADS: Street Lights may be provided: 1 .
