THAT Report WD-43-90 be received; and 2 . THAT the Director of Public Works be authorized to issue a "Certificate of Acceptance' for the roads, storm drainage system and street lighting constructed within Plan 1OM-766 and 1OR-2213. 3. THAT Council approve the by-law attached to this report (WD-43- 90) assuming the streets within Plan 1OM-766 and 1OR-2213 as public highways assumed by the Town for public use. --------------------------------------------------------------------- REPORT 1.0 ATTACHMENTS No. 1: Key Plan Showing Location of Plan 1OM-766 and 1OR-2213 No. 2: By-law For 1OM-766 No. 3: By-law For 1OR-2213 . . .2 REPORT NO. : WD-43-90 PAGE 2 2.0 BACKGROUND 2 . 1 The Town entered into a subdivision agreement registered on title December 19, 1984 with the Toronto Dominion Bank to develop lands by plan of subdivision, located in Courtice and described as Plan 1OM-766 . Additional lands were developed by Land Division Applications as Shown on Plan 1OR-2213 (see Attachment No. l) . The agreement required the developer to construct the storm sewer system and all roadworks including hot-mix paving, curb and gutter, sidewalks, boulevard sodding, street trees and street lighting. 2 .2 All of the Works were completed and a 'Certificate of Completion' was issued dated September 9, 1988. The Works were placed on a one year maintenance period which expired on September 9, 1989 . These Works were subsequently re-inspected and were found to be satisfactory. 2 . 3 It is now appropriate to issue a 'Certificate of Acceptance' dated May 8, 1990, for these Works, thereby accepting ownership of the roads, storm drainage system and street lights. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2 .4 Further to the issuance of a 'Certificate of Acceptance' , a by- law is required to permit the Town to assume all the streets within Plan 1OM-766 and 1OR-2213 . 3.0 RECOMMENDATION 3 . 1 It is, therefore, recommended that the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system and street lights within Plan 1OM-766 and 1OR-2213 and that Council approve the by-laws attached to this report (WD-43-90) assuming the streets within Plan 1OM-766 and 10R-2213 . . . .3 it REPORT WD. : WD-43-90 PAGE 3 Respectfully submitted, Recommended for presentation to the Committee, ---------------- ------ - ---- ------------------ Walter A. NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follow: 1. THAT the streets and street widening blocks described in Registered Plan 1OM-766 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use 2. THAT the Clerk be authorized to apply to the Land Registry rY Office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-766.
