SUB,JECT: REQUEST TO OPEN THE ROAD ALLOWANCE KNOWN AS
CONCESSION ROAD 4 IN LOTS 32 AND 33,
FORMER DARLINGTON TOWNSHIP (210 FEET)

RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-24-90 be received;
2 . THAT the request from Mr. Domingos Fernandes to open approximately
(210 feet) of the road allowance between Lots 32 and 33 in
Concession 4, former Darlington Township, be approved subject to
Mr. Fernandes entering into an agreement with the Town of Newcastle
to satisfy all requirements of the Town, financial and otherwise;
and

3 . THAT Mr. Fernandes be advised of Council's decision.

2 . 0 BACKGROUND
2 . 1 On February 19th, a meeting was held with Mr. Fernandes to discuss
the opening of the above road allowance. Mr. Ferandes wishes to
obtain a building permit to construct a house on his property.
3 . 0 REVIEW AND COMMENT
3. 1 At the present time, a building permit is not available because the
property in question does not have frontage onto a year-round
maintained road.
3.2 Section 9 .2 of the Town's Zoning By-law states that a building
permit would be available if the property has a minimum of 30
metres (98 .4 feet) of frontage onto a year-round maintained road.
4 . 0 RECOMMENDATION
4 . 1 It is, therefore, recommended that the request made by Mr.
Fernandas to open the road allowance between Lots 32 and 33 in
Concession 4, former Darlington, be approved subject to Mr.
Fernandas satisfying all requirements of the Town, financial and
otherwise.
