Report #: PD -47-96 File #: DEV 96 -002 (X -REF: 18T- 87086) By -law # Subject: REZONING APPLICATION - APPLICANT: CARRUTHERS AND SMITH PART LOT 13, CONCESSION 2, FORMER TOWN OF BOWMANVILLE INTERSECTION OF SCUGOG STREET AND MIDDLE ROAD FILE: DEV 96 -002 (18T- 87086) Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -47 -96 be received; 2. THAT application to amend the former Town of Newcastle Comprehensive Zoning By -law 84 -63, as amended, submitted by Tunney Planning Inc. on behalf of Robert Carruthers and Elizabeth Smith be referred back to Staff for further processing; and 3. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICATION DETAILS 1.1 Applicant: 1.2 Agent: 1.3 Rezoning Application: 1.4 Land Area: 2. LOCATION Carruthers /Smith Tunney Planning Inc. from "Agricultural (A)" to an appropriate zone to permit the development of 5 semi - detached /link lots (10 units) .75 ha (1.8 acres) 2.1 The subject property is located in the triangle formed by the intersection of Middle Road and Scugog Street. It comprises part of Lot 13, Concession 2, former Town of Bowmanville. 512 W REPORT NO. PD -47 -96 PAGE 2 3. BACKGROUND 3.1 The lands subject to the rezoning application were originally identified as a block for future development in Draft Approved Plan of subdivision 18T- 87086. Since that time the development application on the west side of Scugog Street (18T- 88051) has been Draft Approved with a road pattern that would include the subject lands and part of the Scugog Street road allowance for residential lots. Since no use was proposed for the subject lands at the time of Draft Approval no zone category was previously assigned to the lands. 4 EXISTING AND SURROUNDING USES 4.1 The existing site is currently vacant 4.2 Surrounding land uses are as follows: South: vacant land subject to residential development applications and existing residential fronting on Scugog Street. East: vacant land subject to residential development applications North: vacant land subject to development applications West: vacant land subject to residential development applications 5 PUBLIC MEETING AND RESPONSE 5.1 Pursuant to Council's resolution of July 26, 1982 and the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition the appropriate notice was mailed to each landowner and tenant within the 120 metre prescribed distance. As of the writing of this report no letters of objection or concern with regards to the applications have been received, although some neighbouring land owners have enquired with respect to the application. ....3 513 REPORT NO. PD -47 -96 PAGE 3 6.1 Within the Durham Regional Official Plan the subject property is designated Living Area within the Bowmanville Urban Area boundary. The subject application would conform. 6.2 Within the former Town of Newcastle Official Plan the subject property is designated "Low Density Residential" in neighbourhood 2D of the Bowmanville Urban Area. The application would appear to conform. 6.3 Within the Municipality of Clarington Council adopted Official Plan, the subject property is designated "Urban Residential" within Knox neighbourhood (No. 8) of the Bowmanville Urban Area. The application appears to conform. 7 ZONING 7.1 The current zoning on the subject property is Agricultural (A). Said zoning does not permit the development of urban residential lots as proposed, hence the rezoning application. 8 AGENCY COMMENTS 8.1 In accordance with departmental procedure the subject application was circulated to a number of agencies and departments for comment. To date comments remain outstanding from the majority of the circulated agencies including; Regional Works, Regional Planning, the Public and Separate School Board, Central Lake Ontario Conservation Authority and the Public Works Department Engineering and Parks Divisions. 8.2 The Fire Department has advised that they have no objection to the proposal. ...4 514 REPORT NO. PD -47 -96 PAGE 4 9 STAFF COMMENTS 9.1 Plan of Subdivision 18T -87086 was originally Draft Approved with the subject lands as Block 192 for Future Development. The applicant, at the time, proposed to develop the block commercially together with the abutting portion of the Scugog Street road allowance and lands in subdivision application 18T- 88051. 9.2 The applicant is no longer interested in pursuing commercial development on this block and has proposed a lotting scheme as indicated on Attachment No. 2. Staff are generally satisfied with the proposed concept. The owner of the adjacent lands, is also agreeable to the proposed lotting and is willing to make the necessary revisions to his plan to ensure the two plans conform. 9 CONCLUSION 9.1 The purpose of this report is to facilitate the Public meeting as required by the Planning Act, to provide Committee and Council with some background on the application submitted and for Staff to indicate issues or area of concern regarding the subject application. It is recommend the application be referred back to Staff for further processing and subsequent report upon receipt of all outstanding comments.
