THAT Report PSD-048-05 be received; and 2. THAT Council concurs with the decision of the Committee of Adjustment made on March 24, 2005 for applications A2005/007 and A2005/008; and that Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment. The purpose of the minor variance application and the Committee's decisions are detailed in Attachment 1. The decisions of the Committee are detailed below. DECISIONS OF COMMITTEE OF ADJUSTMENT FOR MARCH 24, 200S A2005/007 Approve with conditions Approved with conditions A2005/008 Table Tabled 2.0 COMMENTS 2.1 A2005/007 was an application to reduce the minimum exterior side yard setback from 6 metres to 2 metres to allow for the expansion of the existing residential dwelling, and an attached garage. The exterior side yard of this lot is adjacent to an un-opened road allowance. Due to the alignment of the driveway, the applicant wished to build the garage as requested, towards the western property line. The application was approved, subject to Engineering Services requirement that no excavating, placement of fill, landscaping or construction activity take place in the road allowance 2.2 A2005/008 was an application to reduce the front yard setback for low-rise condominium apartment buildings from 7.5 metres to 2 metres. Engineering Services requested that the application be tabled until the applicant could satisfy the Engineering Services Department that the proposed setback provided sufficient space to allow for a proper transition between the front property line and the barrier free accesses into the building. The applicant was satisfied with the request, and Committee tabled the application for a period of no more than three (3) months. 2.3 Staff has reviewed the Committee's decisions and is satisfied that the application that received approval is in conformity with the Official Plan policies, consistent with the intent of the Zoning By-law and are minor in nature and desirable. Council's concurrence with the Committee of Adjustment's decision is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of any decision of the Committee of Adjustment.
