By-law 2026-075
Being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for The
Corporation of the Municipality of Clarington to lift the Holding (H) Symbol on lands
located at Part of Lot 9, Concession Road 2, Plan 40M-2804, subject to DR2495369
Municipality of Clarington in Newcastle (S -C-2022-0008 — 248 Mearns Avenue,
Bowmanville)
Under the authority granted by the Province of Ontario through the Municipal Act, 2001,
S.O. 2001, c.25 and the Planning Act, R.S.O. 1990, c. P.13, Municipal Council has
delegated to the Deputy CAO, Planning & Infrastructure, with the passing of By-law
2024-042, as amended, the authority to approve applications to remove Holding (H)
Symbols and pass related by-laws pursuant to s.34 of the Planning Act.
Whereas the Deputy CAO, Planning & Infrastructure is satisfied that the conditions for
removing the Holding (H) Symbol as shown on Schedule "A" to this By-law have been
satisfied.
Now therefore, be it enacted, and it is hereby enacted as a by-law of The Corporation of
the Municipality of Clarington as follows:
Schedule "4" to By-law 84-63, as amended, is hereby further amended by
changing the zone designation from:
"Holding -Urban Residential Type Two Exception ((H)R2-84)" to "Urban
Residential Type Two Exception (R2-84)"
"Holding -Urban Residential Type Two Exception ((H)R2-9)" to "Holding -Urban
Residential Type Two Exception (R2-9)"
2. Schedule "A" attached hereto shall form part of the By-law.
3. This By-law shall come into effect on the date of approval, subject to the provisions
of Sections 34 and 36 of the Planning Act.
