S[RJEC'T: REQUEST TO OPEN •THE ROAD ALLOWANCE BETWEEN LOTS 10 & 11 IN
CONCESSION 10, SOUTHERLY FOR APPROXIMATELY 271 METRES (890
FEET) - MR. DAVID LUPI
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-19-90 be received;
2 . THAT the request from Mr. David Lupi to open approximately 271
metres (890 feet) of the road allowance between Lots 10 & 11
in Concession 10, former Darlington Township, be approved
subject to Mr. Lupi entering into an agreement with the Town
to satisfy all requirements of the Town and the Canadian
Pacific Railway, financial and otherwise; and
3 . That Mr. David Lupi be advised of Council 's decision.

2 .0 BACKGROUND
2 . 1 On February 8, 1990, a meeting was held with Mr. David Lupi and Ms.
Barbara Hoc to discuss the opening of the above road allowance.
2 .2 Mr. Lupi and Ms . Hoc wish to obtain a building permit to construct
a house on the property immediately south of the Canadian Pacific
Rail line (Attachment No. 1) .
3 .0 REVIEW AND COMMENT
3 . 1 At the present time, a building permit is not available because the
property in question does not have frontage onto a year-round
maintained road.
3 .2 Section 9 .2 of the Town's Zoning By-law states that a building
permit would be available if the property has a minimum of 30
metres (98 .4 feet) of frontage onto a year-round maintained road.
3 .3 There is a Canadian Pacific level crossing on this road allowance
and the applicant has been advised that he must satisfy the
requirements of the railway.
4 .0 RECOMMENDATION
4 . 1 It is, therefore, recommended that the request made by Mr. Lupi to
open the Road Allowance between Lots 10 and 11, Concession 10,
former Township of Darlington be approved subject to Mr. Lupi
satisfying all requirements to the Town and Canadian Pacific
Railway, financial and otherwise.
