THAT Report WD-10-90 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Completion' for Phase VI of Burketon Hills Estates (Boundary Road) , Plan 1OM-802; and 3 . THAT a copy of this report be forwarded to Mr. J. Croxall, G.M. Sernas & Assoicates Ltd. , 110 Scotia Court, Unit 41, Whitby, Ontario, L1N 8Y7 . ----------------------------------------------------------------- REPORT 1.0 ATTACHMENT No. l: Key Plan Showing Location of Plan 1OM-802 . . . .2 REPORT NO. : WD-10-90 PAGE 2 2 . 0 BACKGROUND 2 . 1 The Town entered into a Subdivision Agreement on July 28, 1983 with United Counties Holdings Limited, Veltri and Son Limited, Lesron Enterprises Limited and Susan Ann Swartz to develop lands in Burketon. 2 .2 The Works have been completed and deemed satisfactory with respect to initiating the required maintenance period, as set out in the subdivision agreement. 2 . 3 Sections 46 and 47 of the Subdivision Agreement read as follows: 46) REQUIREMENTS FOR CERTIFICATE OF COMPLETION The owner agrees that the construction and installation of any of the Works shall not be deemed to be completed for the purposes of this Agreement until the Director has provided the Owner with written confirmation thereof, referred to herein as a "Certificate of Completion" . In addition to any other requirements contained herein, no Certificate of Completion shall be issued until: 1) Such of the Works authorized by the Authorization to Commence Works for which a Certificate of Completion is required, have been inspected by the Director, and the Town Council has approve the written report of the Director that such Works have been constructed and installed in accordance with the latest version of the engineering drawings approved by the Director; and . . . 3 1028 REPORT NO. : WD-10-90 PAGE 3 2) The Town is satisfied that, in respect of the construction and installation of all of the Works authorized by such Authorization to commence works, there are no outstanding claims relating to such Works. 47) PERIOD OF REQUIRED MAINTENANCE OF WORKS The owner shall from the date of the issuance of Certificate of Completion maintain all of the Works covered by such Certificate of Completion for a period to two (2) years. 2 .4 Public Works Staff have inspected these Works and have found them to be constructed satisfactorily and in accordance with the approved engineering drawings . In addition, there are no outstanding claims which relate to these Works . 3 . RECOMMENDATION 3. 1 It is, therefore, recommended that the Director of Public Works be authorized to issue a 'Certificate of Completion' for Phase VI of Plan 1OM-802, dated December 1, 1989, Burketon Hills Estates (Boundary Road) . i i Respectfully submitted, Recommended for presentation to the Committee, ------ ---- ----------------- Walter A.
