Property Standards Committee Minutes Minutes November 5th, 2025, 6:30 p.m. 40 Temperance Street, Bowmanville Council Chambers, 2nd Floor Date: November 5th, 2025 Time: 6 :3 0 p.m. Place: Clarington Council Chambers Present: Shireen Gray, Appellant Committee members: D. Eastman, W. Partner, S. Pohjola Staff Present: N. King, P. Di Rienzo, N. Neadles, R. Ryan, A. Parsons, Municipal Law Enforcement Officer M. Ashraf 1. Call to Order D. Eastman, called the meeting to order at 6:43 pm 2. Land Acknowledgement Statement Secretary, N. Neadles opened the meeting with the land acknowledgment statement. 3. Declaration of Interest There were no declarations of pecuniary interest stated at the meeting. 4. Appeal Number PSA-01-2025 file #2025-04381 a. 126 Bonnycastle Drive, Bowmanville, PIN 269340071 – File number MCMP- 2025-04381. D. Eastman spoke to general house keeping matters. Neadles, Secretary, read the legal address of the appealed property into the record: 126 Bonnycastle Drive Bowmanville, ON PLAN 40M1734 PT LOT 12 NOW RP 40R 15241 PART 1 CORN ER AC 41.27FR D D. Eastman clarified with Officer Ashraf that he did not have any preliminary matters the Committee needed to be made aware of. D. Eastman explained the process of the hearing to the Appellant and called Officer Ashraf to provide his statement. Officer Ashraf advised that he performed an initial inspection of the subject property on September 4th, 2025 (notes and photos provided) which is when he determined there was a violation of the Property Standards Bylaw. Officer Ashraf spoke with the Appellant on September 5th, 2025, via telephone, attempting to advise of the received complaint, and observed violations that were noted during his inspection. The Appellant disputed these findings, and Officer Ashraf indicated that an Order to Comply within prescribed timelines would be issued. The Appellant indicated they were unable to meet with Officer Ashraf at her property to discuss details of the Order, and they were informed that accordingly, it would be mailed to her instead. Officer Ashraf mailed the Property Standards Order through regular and registered mail on September 10, 2025, and confirmed to the Committee the original compliance deadline of October 15, 2025. D. Eastman confirmed the Appellant received the inspection photographs and provided an opportunity for the Appellant to ask Officer Ashraf any questions. The Appellant inquired about documents that were filed through the complaint process A discussion ensued between the Committee and Officer Ashraf, regarding the condition of the subject property during his initial inspection, and Officer Ashraf further confirmed that a recent inspection on November 4th, 2025, showed little change or improvement to the condition of the property. Reinspection photographs were displayed on the overhead projector. D. Eastman called the Appellant to provide her statement. The Appellant explained that items in question were materials from inside a shed in the rear yard, that was in disrepair and had been torn down. Clarifying the items were not debris, the Appellant indicated the subject materials would be returned inside the new shed once construction was complete. Clarington Property Standards Appeal November 5, 2025 A discussion between the Committee and the Appellant ensued regarding a timeline for completing the shed construction and returning the subject items inside the new shed. It was further questioned whether all the current items outside would fit inside the new structure. The Appellant confirmed all items will fit inside the new structure, and the current timeline for completion of the shed is the end of November. W. Partner asked Officer Ashraf if they can recommend an acceptable timeline for a proposed extension. Officer Ashraf indicated that two weeks would be acceptable. D. Eastman advised the Appellant of the requirements as set out in the By-law and noted the implications of failing to comply with an extension that may be provided by the Committee. D. Eastman explained that upon re-inspection, if the property has not been brought into compliance, the Municipality has the authority to hire a contractor to complete any work necessary to bring the property into compliance, and charge incurred fees, along with an administrative fee, back onto the tax roll of the respective property. Recess D. Eastman requested a motion from the Committee to recess and consider a decision. Moved by W. Partner Seconded by S. Phojola Carried The meeting was called back to order at 8:02 pm. The Committee presented the decision to the Appellant: Property Standards Committee confirms the Property Standards Order that was issued through registered mail on September 10th, 2025, be given an extension until November 21st, 2025. D. Eastman advised the Appellant that if they were dissatisfied with the decision of the Committee, an appeal with the Superior Court at 150 bond St. in Oshawa can be filed within 14 days. The Secretary handed out a signed copy of the Committee’s decision to all required parties. 5. Adoption of Minutes Clarington Property Standards Appeal November 5, 2025 S. Pohjola advises D. Eastman that W. Partner is prepared to make a motion to adopt the Minutes of November 5th, 2025, meeting. Seconded by W. Partner. Carried 6. Property Standard Procedure Carried 7.
