THAT Report WD-8-90 be received; 2 . THAT an agreement be entered into with Mr. Mecola' Uxi'adka'+ to provide that the Town perform year-round maintenance of his laneway until such time as the property changes hands, after which time the Town will no longer carry-out maintenance of thellaneway and that j this agreement be registered on 'title; and 3 . THAT Mr. Anthony E. Laskowsky I i . . .2 101 i REPORT NO. : WD-8-90 PAGE 2 2 . 0 BACKGROUND i 2 . 1 At a regular meeting held on September 5, 2989, the General Purpose and Administration Committee considered Report WD-74-89, Maintenance of Private Laneways, Grace, Trewin and Uriadka and by Resolution #GPA-639-89 recommended to Council that the recommendations in the report be approved. Council approved the recommendation of the General Purpose and Administration Committee at a regular meeting held on September 11, 1989 . 2 .2 Mr. Anthony Laskowsky, solicitor representing Mr. M. Uriadka has advised that his client has chosen the option that the Town maintain his laneway until the property changes hands . (Attachment No. 2) . 3. 0 RECOMMENDATIONS 3 . 1 It is, therefore, recommended that an agreement be entered into with Mr. Mecola Uriadka that the Town perform year-round maintenance on his laneway until such time that the property changes hands after which time the Town will no longer carry-out any maintenance of the laneway and that this agreement be registered on title. (A) Dear Marie: RE: Maintenance of Private/Laneways - Grace, Trewin and Uriadka Your File: 77.2.122 t/ Please be advised that Mr. Uriadka originally was prepared, and still is prepared, to give to the Corporation of the Town of Newcastle a strip of land sixty-six feet in width; however, he insisted that such strip start on one road allowance and end at the other road allowance which would provide some continuity in the development of the said lands in the future, rather than have the strip end in a dead end. Unfortuntely this was not acceptable to Mr. W. A. Evans who opposed to the idea as it would effectly create two parcels of land. Mr. Uriadka therefore requests that the Town provide year around main- tenance to the laneway, until such time as the property changes hands. Thanking you, Yours e t ru y, Anthony E.
