By-Law # -� METING: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: FEBRUARY 5, 1990 REPORT #: WD-7-90 FILE #: SUB.ECT: PENWEST SUBDIVISION - BOWMANVILLE PHASE I - Plan 1OM-782 'CERTIFICATE OF ACCEPTANCE' AND ' ASSUMPTION BY-LAW' ROADWAYS AND STORM SEWER SYSTEM RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-7-90 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, storm drainage system and street lighting constructed within Plan 1OM-782; and 3 . THAT Council approve the by-law attached to this report (WD-7-89) assuming the streets within Plan 1OM-782 as public highways assumed by the Town for public use. --------------------------------------------------------------------- REPORT 1. BACKGROUND 2 . 1 The Town entered into a subdivision agreement registered on August 8, 1986, with Penwest Development Corporation Limited to develop lands by plan of subdivision, located in the former Town of Bowmanville and described as Plan 1OM-782 (see Attachment No. 1) . The agreement required Penwest Development Corporation Limited to construct the storm sewer system and all road works including hot- mix paving, curb and gutter, sidewalks, boulevard sodding, street trees and street lighting. I 2 .2 All of the Works were completed and a 'Certificate of Completion' was issued dated September 30, 1988 . The Works were placed on a one year maintenance period which expired on September 30, 1989 . These works were subsequently re-inspected and were found to be satisfactory. i 2 .3 It is now appropriate to issue a 'Certificate of Acceptance' dated February 12, 1990, for these Works, thereby accepting ownership of the roads, storm drainage system and street lights . The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. I 2 .4 Further to the issuance of a 'Certificate of Acceptance' , a by-law is required permit the Town to assume all the streets within Plan 1OM-782 . 3 . RECOMMENDATION 3 . 1 It is, therefore, recommended that the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, j i storm drainage system and street lights within Plan 1OM-782 and that Council approve the By-Law attached to this report (WD-7-89) assuming the streets within Plan 1OM-782 . NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follow: 1. THAT the streets and street widening blocks described in Registered Plan 1OM-782 (described in Schedule "A" attached hereto and forming part of this By-Law) all being in the Town of Newcastle, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Town of Newcastle as public highways, and assumed by the said Corporation for public use 2 . THAT the Clerk be authorized to apply to the Land Registry Office to have the Corporation of the Town of Newcastle shown as the owner of the streets on Plan 1OM-782 . NOW THEREFORE, the Council of the Corporation of the Town of Newcastle enacts as follow: 1.
