HomeMy WebLinkAbout2025-043If this information is required in an alternate format, please contact the Accessibility Co-ordinator at 905-623-3379 ext. 2131 The Corporation of the Municipality of Clarington By-law 2025 - 043 Being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for The Corporation of the Municipality of Clarington, with respect to Temporary Seasonal Patios on various privately owned properties within the Municipality. The Municipality of Clarington enacts: 1. The lands subject to this by law are listed below and may be amended as necessary; i. 1413 Highway 2, Courtice (Bistro 238) ii. 1437 Highway 2, Courtice (The Courtyard) iii. 2372 Highway 2, Bowmanville (Boston Pizza) iv. 164 Baseline Road East, Bowmanville (Lightcaster) v. 119 King Avenue West, Newcastle (Old Newcastle House) 2. This By-law will be in full force and effect between May 1, 2025, and October 31, 2025. 3. Nothing in Zoning By-law 84-63, as amended, applies to prevent the use of a temporary seasonal patio on the identified lands subject to this By-law, provided that it: i. Shall be set back a minimum of 10 metres from a low-rise residential zone; ii. No additional parking shall be required for an outdoor patio where the outdoor patio does not exceed 50% of the gross-floor area of the premises it serves; and iii. Shall comply with the Municipally Approved Site Plan and Design Requirements 4. Under the authority granted by the Province of Ontario through the Municipal Act, 2001, S.O. 2001, c.25 and the Planning Act, R.S.O. 1990, c. P.13, Municipal Council has delegated to the Deputy CAO of Planning & Infrastructure Services, with the passing of By-law 2024-042, the authority to approve temporary use zoning by-laws and pass related by-laws pursuant to s.34 of the Planning Act. Now therefore, be it enacted, and it is hereby enacted as a by-law of The Corporation of the Municipality of Clarington as follows: 5. This By-law shall come into effect on the date of approval, subject to the provisions of Sections 34 and 36 of the Planning Act, between May 1, 2025, and October 31, 2025.
