By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION MEETING DATE: OCTOBER 31, 1988 REPORT #:WD-71-88 FILE #: aRJECT: DEDICATION OF PART 4 OF' PLAN 1OR-1645 AS PUBLIC ROAD ALLOWANCE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT this report be received; and 2. THAT a by-law be passed to dedicate Part 4 of Plan 1OR-1645 as public road allowance and that the Mayor and Clerk be authorized to execute said by-law. 3. THAT a copy of this report be forwarded to Mr. David J. Gillespie, Barrister & Solicitior, 2nd Floor, P.O. Box 208, 214 Dundas Street East, Whitby, Ontario, LlN 5S1. REPORT 1.0 BACKGROUND 1.1 Attached is a letter from David J. Gillespie, requesting the removal of a 1 foot reserve which is described as Part 4 of Plan 1OR-1645 Isee Attachment No.l(a) and l(b) }. 2 Page 2 WD-71-88 i 1.2 The purpose of Mr. Gillespie's request is to provide clear and unobstructed i access to his client's property. 1.3 The property in question is located in Solina on Davis Court (see Attachment No.2) . 1.4 The northerly portion of Davis Court was protected by a 1 foot reserve to control the development of Block 9 (see Attachment N0.2) . 1.5 We have reviewed Mr. Gillespie's request and find no objecton to the granting of same. 2.0 RECOMMENDATION 2.1 It is, therefore, recommended that a by-law be passed to dedicate Part 4 of Plan 1OR-1645 as public road allowance and that the Mayor and Clerk be authorized to execute said by-law. i Respectfully submitted, Recommended for presentation to the Committee, I i a.. There is a one foot reserve on the premises in favour of the Town of Newcastle . A copy of the plan is enclosed herein. A title search reveals that part of the reserve (Block 12 ) has been removed and a by-law registered. I am therefore requesting that another by-law be registered removing the said one foot reserve as it pertains to my client ' s lands .
