HomeMy WebLinkAboutWD-59-88 TOWN OF NEWCASTLE REPORT P O R T F i l e # -��-= Res. 6" By-Law # ` NEETING: GENERAL PURPOSE AND ADMINISTRATION MEETING DATE: SEPTEMBER 6, 1988 REPORT #: WD-59-88 FILE #: SlB,JECT: DEDICATION OF PART 9, PLAN 1OR-1502 AS PUBLIC ROAD ALLOWANCE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT this report WD-59-88 be received; and 2. THAT a By-law be passed to dedicate Part 9 of Plan 1OR-1502 as Public Road Allowance and that the Mayor and Clerk be authorized to execute the said by-law; and 3. THAT a copy of this report be forwarded to Mr. Henry Silver, Barrister & Solicitor, 345 Kingston Road, Suite 305, Pickering, Ontario, Llv lAl. i 1.0 BACKGROUND 1.1 Attached is a letter from Henry Silver requesting the dedication of Part 9 of Plan 1OR-1502, (see Attachment No.l) . 1.2 The purpose of Mr. Silver's request is to provide clear and unobstructed access for his client's property which is located in the Broken Front Concession, Lot 21, as shown on Attachment No.2. . . .2 IJ Page 2 WD-59-88 1.3 We have reviewed this matter and find that the Town purchased Part 9 of Plan 10R-1502 to facilitate the future reconstruction of Holt Road, However, this parcel of land was never dedicated as public road allowance. 1.4 In order to legally define the lands that constitute the Holt Road road allowance, Part 9 of Plan 1OR-1502 should be dedicated as public road allowance at this time, (see Attachment No.3) . 2.0 RECOMMENDATION 2.1 It is, therefore, recommended that a by-law be passed to dedicate Part 9 of Plan 1OR-1502 as public road allowance and that the Mayor and Clerk be authorized to execute said by-law. Attention : Walter Evans Director , Public Works Dear Sir: t� aW Re: Part Lot 21 , Broken Front Concession , designated as Part 9 , Plan lOR- 1502 , Geographic Township of Darlington I am the solicitor for Ravinder Pasricha who is the owner of a certain parcel of property located on the west side of Holt Road immediately north of the 401 Highway. On the 8th day of August , 1984 , the prior owner , Samuel LeRoy Van Camp , conveyed to the Corporation of the Town of Newcastle Part 9 on Plan IOR- 1502 which constitutes a strip along the front of Mr. Pasricha ' s property. There is registered in the Registry Office Instrument No. 118617 which contains a certified copy of Town of Newcastle By-Law 82-79 . This By-Law authorizes the Town to purchase the above-noted property. There is a reference in the By-Law that the property is being purchased for the reconstruction of Holt Road between Highway 401 and Baseline Road . There is nothing registered against the title which indicates that the property is dedicated as a public highway . Would you firstly indicate to me whether in fact there is .ion existence a by- law dedicating the subject property as a public highway . If there is no such by-law , would you kindly attend to the preparation of such a by- law and the presentation of this by- law to the Council of the Town for enactment. For your convenience, I enclose a copy of Plan IOR- 1502 which shows the subject property as Part 9 .
