By-Law MEETING: GENERAL PURPOSE AND ADMINISTRATION MEETING DATE: SEPTEMBER 6, 1988 REPORT #: WD-55-88 FILE #: SUD.ECT: DEDICATION OF PART 6, PLAN 1OR-757 AS PUBLIC ROAD ALLOWANCE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-55-88 be received; and 2. THAT a by-law be passed dedicating Part 6 of Plan 1OR-757 as Public Road Allowance and that the Mayor and Clerk be authorized to execute the necessary documents; and 3. THAT a copy of this report be forwarded to Anise Hietapakka, Barrister & Solicitor, 42 Princess Street, Toronto, Ontario, M5A 4G6. REPORT 1.0 BACKGROUND 1.1 Attached is a copy of a letter from Anise Hietapakka (Attachment 1) requesting the dedication of a road widening on part Lot 14, Concession 4, Former Clarke Township, described as Part 6 of Plan 1OR-757, (see Attachment No.2) . . . .2 Page 2 WD-55-88 1.2 The section of Concession Road 4 referred to in this report is shown on Attachment No.3. 1.3 The purpose of Anise Hietapakka request is to obtain clear and unobstructed access to their client's lot abutting Plan 1OR-757. 1.4 We have reviewed this matter and find we have no objections to Anise Hietapakka's request. 2.0 RECOMMENDATION 2.1 It is, there, recommended that a by-law be passed to dedicate Part 6 of Plan 1OR-757 as public road allowance and the Mayor and Clerk be authorized to execute said by-law. I act on behalf of the above-noted Mr. and Mrs. Berzins who purchased the above-noted property from Margaret Jeanette Layng on May 2nd, 1988.and, in searching title to the said lands, it appears that lands deeded to the Town of Newcastle by the former owner, Mrs. Layng, known as Part 6, Reference Plan lOR-757, for purposes of road-widening,have never been subsequently dedicated by the Town for public use. Accordingly, for purposes of setting all in order with respect to title and use of the land, would you kindly arrange for the lands.-to be. duly" dedicated and advise me upon completion of same. Enclosed for your convenience is a copy of Mrs. Layng's Deed to the Town. Mrs. Layng was registered .on title by Instrument No. 48690 and transferred the property to Mr. & Mrs. Berzins by Instrument No. 141874, May 2nd, 1988.
