RECOMMENDATIONS:
It is respectully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-33-88 be received; and,
2. THAT the Town clean out and reshape the ditch through Mr. Johnston's
property at 15 Concession Street East, Bovnmanville; and,
3. THAT the cost of this work be charged against "Allowance For
Construction At Unspecified Locations" and,
4. That a copy be forwarded to Mr. A.H. Johnston, 15 Concession Street
East, Bowmanville, L1C 1Y2.

2.0 BACKGROUND
2.1 At the meeting of Council held November 24, 1986, Resolution #C-972-86
was passed as follows:
"THAT the communication dated November 11, 1986, from Mr. A.H. Johnston,
15 Concession Street East, Bowmanville, requesting that Council
review the drainage problems that are affecting his property
and have them corrected be received; .
AND THAT the communication be referred to the Director of Public
Works and the Director of Planning for review, and a joint report
to the General Purpose and Administration Committee;
AND FURTHER THAT Mr. Johnston be advised of Council's decision.
3.0 THE PROBLEM
3.1 On Tuesday, April 26, 1988 a meeting was held with Mr. Johnston
at which time his concerns were reviewed and discussed.
Mr. Johnston's concerns can be summarized as follows:
3.1.1 For several years, the development which has taken place north
of Concession Street and west of Liberty Street has resulted
in the deposition of silt and debris in the creek which flows
through Mr. Johnston's property (see Atachment C) .
3.1.2 The majority of the flow from the north has now been diverted
into the storm sewer on the north side of Concession Street with
the result that the flow in the creek through Mr. Johnston's property
is now intermittent and during most periods there is little or no flow
in the creek. As further development occurs to the north the flow
in the creek will be almost non existent.
3.1.3 The silting up of the creek has resulted in blocking the flow from
the building foundation draining from Mr. Johnston's house.

4.0 DISCUSSION
4.1 Mr. Johnston is upset about the loss of flow in the creek through his
property but acknowledged at the meeting that there is little or
nothing that can be done about that problem at the present time.
Mr. Johnston has requested that the Town remove the silt and debris
from the creek and reshape the creek as required.
5.0 RECOMMENDATION
5.1 It is recommended that the Town clean out the creek through Mr. Johnston's
property and reshape it as required and that the cost of this work
be charged to against the funds provided in the Capital Budget in
the category "Allowance For Construction At Unspecified Locations" .

May I briefly outline a problem we have at our home at 3°
15 Concession St. E. Bowmanville. /
Our house was built by Mr. E. Laird in 1956 under the vigilance
of the authorized inspectors, as required by C.M.H.C. In
accordance with the National Housing Act. Drainage tiles were
placed around the foundation and directed to the small creek
which runs through the east side of our property. This was done
with full approval of the inspectors, and for some time now it
� ) has been a most unsatisfactory arrangement.

Our drainage tiles have nowhere to empty as the creek bed is
well above the opening of the tiles, resulting in our tiles being
S full of water most of the time. The reason for this is that large
amounts of mud, sand, gravel etc. have come through the storm
1_ sewer which empties into our creek. This storm sewer Colpt a S
from north Liberty and adjoining streets. On many occasions
over the years, we have met with representatives of the Bowmanville
and Hampton Public Works Department. We were told that the lack of
proper filters while Saunders, Lorraine, and now High Street
subdivisions were under construction caused our problem.
In 1977 Mr. Ferguson from the Hampton office arranged for men.
to come in and dig out some of the creek bed and clean up the mess
on the lawns adjacent to the creek. Through Mr. Gray., also of
Hampton office, in 1985 Mr. Bev Johnson of Duntri Construction
looked at our problem and agreed that we were getting the mud, j
sand etc. from the High Street Project. A blanket type filter was
�2 1 put up near the exit of the storm sewer, but when this failed they
added some bales of straw, but again this was useless. Mr. Johnson
,;. sent a man down who did shovel out some of the creek bed and again
cleared up our lawns where this debris had spread over during
high water periods .

Last fall Mr. L. Tracey of Biddle Associates, who had taken over
at the High Street Site, came to see us and again admitted
responsibility for not having proper filters at the site. Nothing
was done, but after I called, he came with two associates on
October 31 , 1986. They came when I was not at home but talked to
my wife, but made no commitment.
Over the last several years this situation has not only been
frustrating, but costly to us. We have had water damage in our
basement, tradesmen in to check our tile beds, right down to
footings on outside walls, plumbers who some time ago installed a
sump pump in the basementw,e1A:q presently is taking all the water
from our drainage tiles into the floor box and then up to ground
level and piped out to the creek. During any excessive wet
4 periods, or if our power was off for a period of time, we have
a crisis.
It seems no-one can help us until the creek bed is lowered to normal .

Over the years, I have checked with C.L.O.C.A. several times about
this stream which has been running through this area as long as
anyone can remember. They say that the subdividers at the
construction site are required to provide proper filters to avoid
such happenings, and that it is the responsibility of the
municipality to see that this is done.
Everyone is sympathetic and many have accepted blame and provided
some help, but our problem continues.
After years of trying unsuccessfully and expensively to cope, I ;`
am now turning to you for help. We have to get our creek back to
its natural state, if you require more information please ask or
come and see for yourselves what we are asking for.
