RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:

1. THAT Report WD-30-88 be received; and,
i

2. THAT a by-law be authorized to dedicate Blocks 82, 83, 85, 87 and 88
of Plan IOM-781 as public road allowance and that the Mayor and
Clerk be authorized to execute said by-law; and,
3. THAT a copy of this report be forwarded to Mr. Grant Armstrong,
McGibbon, Bastedo, Armstrong & Armstrong, Barristers and Solcitors,
P.O. Box 2398, 32 Simcoe Street South, Oshawa, L1H 7V6.
REPORT
1.0 BACKGROUND
1.1 Attached is a copy of a letter from Mr. Grant Armstrong, (Attachment 1)
requesting that the 0.3 metre reserves described as Blocks 82,
83, 85, 86, 87 of Plan IOM-781 be removed and dedicated as public road
allowance.

1.2 The purpose of Mr. Armstrong's request is to provide clear and
unobstructed access to the lots of Plan 1OM-796 which abuts Plan 1OM-781.
1.3 Plan 1OM-781 is located in Courtice east of Townline Road South as
shown on Attachment 2.
1.4 The purpose of the 0.3 metre reserves mentioned in Mr. Grant's
letter were originally placed to control access to undeveloped
lands until such time that these lands would be developed in a
manner satisfactory to the Town.
1.5 we have reviewed Mr. Armstrong's request and find we have no
objection to the removal of Blocks 82, 83, 85 and 87 since the
lands originally protected by these reserves (Plan 1OM-796)
are now developed and these reserves are no longer required.
1.6 Block 86 however, cannot be removed at this time since a portion
of this block is required to restrict access from undeveloped
lands.
1.7 In order to facilitate the removal of a portion of Block 86, a
reference plan is required to divide Block 86 into parts.
1.8 Mr. Armstrong has been contacted and is aware of our requirements
to remove a portion of Block 86. He has advised us that he will
proceed at a latter time with this matter.

1.9 Block 88 of Plan 1OM-781 (Attachment 2) is also a 0.3 metre reserve
which was originally placed to control development and now is
no longer required and should be removed and dedicated as public
road allowance.
2.0 RECOMMENDATION
2.1 It is, therefore, recommended that a by-law be passed to dedicate
Blocks 82, 83, 85, 87 and 88 of Plan 1OM-781 as a public road
allowance and that the Mayor and CLerk be authorized to execute
said by-law.

Further to our telephone conversation today (Beth) we are writing to
request that the one foot reserves described as Blocks 82, 83, 85 and 87, Plan
1OM-781, Town of Newcastle be lifted and dedicated as public highways.
We advise that we have previously also written to you to request that Block 86,
Plan 1OM-781 be also lifted and dedicated as in our letter of December 7th
and reply from Larry Taylor dated December 18th, 1987, copies enclosed.
We enclose a copy of Plan 1OM-781 for your information, and please contact
the writer if any further information is required.
