HomeMy WebLinkAboutWD-28-88 i TOWN OF NEWCASTLE REPORT File # Res. # '�`9- 4�- 4 By-Law # x MEETING: GENERAL PURPOSE AND ADMINISTRATION MEETING I DATE: MAY 16, 1988 REPORT #: WD-28-88 FILE #: SUB.ECT: DEDICATION OF BLOCK 93, BLOCK 95 and BLOCK 97 PLAN 1OM-785 AS PUBLIC ROAD ALLOWANCE i RECOMMENDATIONS: it is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-28-88 be received; and, 2. THAT a By-law be passed to dedicate Block 93, Block 95 and Block 97 of Plan 1OM-785 as public road allowance and that the Mayor and Clerk be authorized to execute the said by-law; and, 3. THAT a copy of this report be forwarded to Mr. Bolotenko, Aitchison & Bolotenko, Barristers & Solicitors, 115 Simcoe Street South, P.O. Box 978, Oshawa, L1H 7N2. 1.0 BACKGROUND 1.1 Attached is a copy of a letter from Aleksandr G. Bolotenko (Attachment 1) requesting the removal of a 0.3 metre reserve, referred to as Block 93, Plan 1OM-785. (Attachment 2) . . .2 i PAGE 2 REPORT NO. WD-28-88 1.2 Plan 1OM-785 is Phase I of River Valley Estates, which is located in Bowmanville as shown on Attachment 2. 1.3 The purpose of Mr. Bolotenko's request is to provide clear and unobstructed access to the lots in River Valley Estates, Phase 2, Plan 1OM-791 which abuts Plan 1OM-785. (refer to Attachment 2) 1.4 Upon reviewing Mr. Bolotenko's request we find that in addition to Block 93, Block 95 and 97 of Plan 1OM-785. (refer to Attachment 2) also control access to Plan 1OM-791. 1.5 The purpose of these 0.3 metre reserves was to control access to the lands to the north of Plan 1OM-785 until such time as a plan was registered for the lands to the north. 1.6 The planning has now been completed for the lands to the north in the form of Plan 1OM-791, therefore the need for these reserves no longer exists. 2.0 RECOMMENDATION 2.1 It is, therefore, recommended that the 0.3 metre reserves be removed and that the appropriate by-law be passed by Council to dedicate Block 93 , Block 95 and Block 97 of Plan 1OM-785 as public road allowance.
