Report Subject: A minor variance application to facilitate the construction of an additional
dwelling unit by reducing the minimum interior side yard setback from 1.8
metres to 1.12 metres, and by reducing the minimum rear yard setback
from 1.8 metres to 1.63 metres.
Recommendations:
1. That the Report for Minor Variance A2024 - 0057 be received.
2. That all written comments and verbal submissions are considered in the deliberation
of this application.
3. That application A2024-0057 for a Minor Variance to Section 3.2 f. ii) b) of Zoning
By-law 84-63 to facilitate the construction of an additional dwelling unit by reducing
the minimum interior side yard setback from 1.8 metres to 1.12 metres, and by
reducing the minimum rear yard setback from 1.8 metres to 1.63 metres be tabled
for a period of up to 60 days to allow for Staff consultation with the applicant and to
ensure all variances are captured accurately.
4. That all interested parties listed in this report be forwarded a copy of Committee's
decision.

2. Background

2.1 On November 18, 2024, the Planning and Infrastructure Services Department received
an application for a minor variance at 40 Prospect Street.
2.2 The application seeks to facilitate the construction of an additional dwelling unit (ADU)
by reducing the minimum interior side yard setback from 1.8 metres to 1.12 metres, and
by reducing the minimum rear yard setback from 1.8 metres to 1.63 metres.
2.3 Ongoing discussions between staff and the applicant are required for this application.
The purpose of tabling this application is to allow the applicant to provide staff with a
revised site plan and elevation drawings that were not submitted with the application
before the January Committee of Adjustmnet deadline. As a result, this application will
need to be tabled as there may be additional variances for the construction of the
additional dwelling unit.
3. Public Notice and Submissions
3.1 Pursuant to the requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject lands. In addition, a public
notice was mailed to each landowner within 60 meters of the subject lands.
3.2 At the time of writing this report, Staff received one inquiry from a member of the public.
The concerns are as follows:

4.1 Given the above, Staff recommends that:
Minor Variance Application A2024-0057 for a minor variance to section 3.2 f. ii) b) of
Zoning By-law 84-63 to facilitate the construction of an additional dwelling unit by
reducing the minimum interior side yard setback from 1.8 metres to 1.12 metres, and by
reducing the minimum rear yard setback from 1.8 metres to 1.63 metres be tabled for a
period of up to 60 days to allow for Staff consultation with the applicant and to ensure all
variances are captured accurately.
