Recommendations: 1. That the Report for Minor Variance A2024-0046 be received. 2. That all written comments and verbal submissions be considered in the deliberation of this application. 3. That application A2024-0046 for a minor variance to section 3.1 c) of Zoning By-law 84-63 to legalize the existing accessory structure to encroach into the interior side yard setback from 0.6 metres to 0.36 metres be tabled for a period of up to 60 days to allow for further discussions between the applicant and staff to acquire more information from the applicant to gain a better understanding of the accessory structures and buildings that were not identified on the materials that were submitted, and to confirm if there are any additional variances required for this application. 4. Background Page 5 2.1 On September 23, 2024, the Planning and Infrastructure Services Department received an application for a minor variance at 6 Vetzal Court. 2.2 The application seeks to legalize the existing accessory structure to encroach into the interior side yard setback from 0.6 metres to 0.36 metres. 2.3 There is a complaint on file (MCMP 2024 — 03257) from a neighbour for the accessory structure regarding drainage issues and how the structure is too close to the fence. 2.4 This application first got tabled back in October of 2024 because there had to be ongoing discussions between staff and the applicant to provide staff with the appropriate floor area of the other accessory structures that were not captured on the site plan that was submitted with this application. As a result, this application got tabled as there may have been additional variances for lot coverage and/or height that were not accounted for. 2.5 This application got tabled again for the January COA meeting as the applicant did not provide staff with the revisions that were required before the deadline to submit the materials. Additionally, the applicant did not pick up their sign and this results in another tabling application as the applicant was unable to meet the legislative requirements under the Planning Act. 3. Public Notice and Submissions 3.1 Pursuant to the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition, a public notice was mailed to each landowner within 60 meters of the subject lands. 3.2 At the time of writing this report, Staff did receive one inquiry from a member of the public. The concerns are as follows: • Grading and drainage issues • Fire and safety concerns about the BBQ shelter 4.
