Mitch Morawetz Proposal: B-2024-0036; An application for consent was received in October 2024. Planning Act Section 53(14) requires the committee to make a decision within 90 days after the day the application is received by the Municipality. The subject application requires a third party peer review by the Regional Health Department. Staff are recommending the subject application to be tabled for a period of up to two years until January 2027, to account for the additional time required to complete the Hydrogeological Study peer review and to adhere to the Planning Act timeline. Background Page 5 2.1 A consent application was received in October 2024, from the owner's agent Mitch Morawetz, to sever lands municipally known as 5800 Main Street, Orono. The effect of the application is to create a new residential lot. The retained and severed parcels associated with the subject application are highlighted in Figure 1. 2.2 The proponent's intention in the future is to sever additional building lots (Parts 2- 7 on the draft reference plan in Figure 2) which will result in subsequent consent application submissions at a later date. 2.3 Regional sewer infrastructure is not available; therefore, this application is subject to review by the Regional Health Department to determine an appropriate lot area for each parcel in demonstrating that each new lot can support private services in the form of a septic system. 2.4 The proponent has prepared and submitted a Hydrogeological Assessment Report in advance of the future consent applications, which has been circulated to Durham Region's Health Department to conduct a peer review of the report. 2.5 The subject application serves the purpose of facilitating the regional peer review of the Hydrogeological Assessment to determine the appropriate lot sizes for the lots indicated on the draft reference plan. 2.6 Staff's recommendation is to table this application, to allow for additional time for Durham Region Health to complete their peer review. A public notice was mailed to each landowner within 60 metres of the subject lands and appropriate signage notifying of the application was installed on the subject lands. Future revisions to the application will require a new circulation of public notice before it is lifted from the table on a future agenda. Municipality of Clarington Committee of Adjustment B-2024-0036 Page 7 3.2 At the time of writing this report, Staff have received no inquiries or opposition from members of the public for this proposed consent application. 4. Departmental Comments 4.1 With the exception of the Region, external agency and internal department circulation for commenting was not required as the application is being tabled to allow for the Regional Municipality of Durham to complete a peer review of the applicant's technical materials. 5. Policy 5.1 A complete policy analysis will be undertaken and included with the future recommendation report for lifting the application from the table. Discussions with the applicant and regional staff are on -going. 6. Recommendation 6.1 Planning Staff recommend that application B-2024-0036 be tabled for a period of up to two (2) years until January 2027, to allow for the Region to conduct an appropriate peer review of the applicant's Hydrogeological Assessment Report.
