SUBJECT: CONDITION OF MEARNS AVENUE, CONCESSION STREET
AND ORCHARD PARK DRIVE IN BOWMANVILLE
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committe recommend to Council the following:
1. THAT Report WD-25-88 be received for information.
REPORT:
1.0 BACKGROUND
1.1 Attached is a copy of a petition (Schedule A) received by the
Town on Monday, March 28, 1988 concerning the maintenance of orchard
Park Drive, Mearns Avenue and Concession Street in Bowmanville.

2.0 ACTION TAKEN
2.1 Attached is a copy of a letter (Schedule B) which has been sent
to the following:
1. Penwest Development Corp. Ltd.
2. Newcastle Gardens
3. River Valley Estates
4. Remlark Subdivision
2.2 In the event that the developer fails to maintain, to our satisfaction,
the streets mentioned in the petition or any other streets affected
by development, Town staff or a contractor on the the behalf of
the Town will perform any necessitated maintenance work and the
appropriate developer will be invoiced accordingly.

PETITION PRESENTED TO COUNCIL ON MONDAY MARCH 28 1988
WE THE UNDERSIGNED WISH TO ADDRESS OUR CONCERNS TO TOWN COUNCIL IN ORDER THAT
IMMEDIATE ACTION CAN BE TAKEN WITH RESPECT TO THE ROAD CONDITIONS OF MEARNS
AVE. AND CONCESSION STREET, ORCHARD PARK DRIVE, IN THE TOWN OF BOWMANVILLE.
WE NO LONGER FEEL THAT WE MUST BE SUBJECTED TO INCONSIDERATE DEVELOPERS, AND
AS SPRING IS NOW UPON US, THE MUD ON THESE STREETS IS BECOMING TOTALLY INTOLERABLE.
FURTHERMORE, IT HAS ALSO BECOME APPARENT THAT DUE TO THE INCREASINGLY AMOUNT
OF MUD, THE WELFARE OF OUR CHILDREN IS AT STAKE. IT IS IMPOSSIBLE TO MAKE A
PROPER STOP OR EVEN STEER A CAR WITH THE GROSS AMOUNT OF MUD ON THESE STREETS.
AS YOU ARE AWARE, MANY CHILDREN MUST WALK OR WAIT FOR A BUS TO GET TO SCHOOL.
THEREFORE, WE RE-ITERATE OUR DEMAND FOR IMMEDIATE ACTION.

Dear Sir:
Please be advised that the Town has received a petition (refer to the
attached Schedule A) regarding the maintenance of subdivision streets and
external streets. The petition deals specifically with the safety of
pedestrians and the excessive mud deposited as a result of vehicular
traffic to and from the site. In addition, to ensure the safety of
pedestrians, dust control and debris and building materials in the road
allowance must be regulated.
The subdivision agreement clearly specifies the developers responsibilities
and obligations with respect to maintenance of these roads and disposal of
litter. In order that we jointly address these problems, we suggest that
the developer advise their builders to initiate whatever action is
necessary to maintain a safe environment for the public in general and that
the inconvenience be kept to an absolute minimum. It is imperative that
these roads be kept in such a manner that safe and adequate access be
maintained and that pedestrian and vehicular movement not be inhibited.
The Town will be monitoring, on a daily basis, the conditions of these
roads and advise the developer accordingly. It seems reasonable that
a 12 hour period of time be granted in order that the condition of the road
be rectified. Should the condition of the road not be improved to the
satisfaction of the Town, the Town will undertake to complete the work and
the associated costs will be invoiced to the developer.
