SUBJECT: POLICY IN RESPECT OF OCCUPANCY OF MUNICIPAL ROADS. i I RECOMMENDATION: It is respectfully recommended : 1 . That this report be received; and, 2. That a by-law be passed establishing Town Policy in respect of the occupancy of Municipal Roads, and the party, organization or agency requiring such occupancy be required to complete, and have approved, a permit for same; and , 3. That 'Road Occupancy' be defined in the Policy, and be categorized as follows: (a) For the moving of wide, heavy or otherwise unconven- tional loads on Municipal roads and rights-of-way. (b) For the excavation , building construction, servicing or modification of any installation, whether Town- owned or of a utility nature, on Municipal roads and rights-of-way; and , (c) For special events of a nature which will impede or otherwise restrict the normal occupation of Municipal roads or rights-of-way by the public at large; and, i i REPORT NO: WD-12-83 - 2 3 (d) For any instance or period of time when it is determined by the Director of Public Works that occupancy by other(s) of a Municipal road or right-of-way may have adverse consequences for the Town if appropriate confirmation and accept- ance of liability is not formalized prior to such occupation. BACKGROUND: On an ongoing basis , utility and service agencies perform work on Municipal roads and rights-of-way, and past practice has been that the agency files an Application for Road Occupancy before undertaking the work. Basically the Road Occupancy Permit defines the conditions of issue, which, primarily, places the responsibility for all liability on the Applicant, and covers areas such as insurance coverage for the duration of the works, restoration of Town property (boulevards, sidewalks , etc.) upon completion, and appropriate notification of the public (detours or warnings) during the course of operations. In cases of this type of occupancy, the Town inspects the completed work and, if necessary, requires the Applicant to remedy any deficiency resulting from same. A permit must also be obtained from the Town in the event that a party wishes to move an oversized or heavy load , using a Municipal road or right-of-way on the route. In these cases the Applicant is required to notify the Police, Ontario Hydro, Bell Canada Limited, and any other agency where plant or installations may be an encumberance to the moving. Again, the Municipality is exonerated from any liability which may result, and any damages to Town property must be made good. The third instance of unusual use of Municipal roads or rights-of-way is on the occasion of parades and other special events which require the occupancy or closure of roads normally used by the public at large. In the past any requests for such events have been handled on an individual basis, necessitating the referral of the request from Council to the Public Works Department, circulation (to the Fire and, if appropriate, Police Departments) and response, through Committee and Council to the originating Applicant. C REPORT NO: WD-12-83 _ 3 - V . .(at The prime reason for any permit approved by the Town is the protection of the Municipality against any liability, whether from expenditure or injury. REPORT: For some time Staff have felt that the method of application for, and issuance of, permits could be improved, and the process speeded up and simplified. From discussions with the Regional Municipality of Durham it has been discovered that two of the necessary permits can be combined on one application form (Occupation for Construction, etc. , and Moving Heavy Loads) which, with minimal modifications, could be used by the Town to advantage. The Region also has a form in respect of Special Events which, although quite basic, does cover all requirements. Attached are the two application forms proposed for use by the Town of Newcastle; the only modifications made to the original provided by the Region is in the name of the municipality. Implementation of these forms, at the earliest possible moment, would be of considerable benefit to the Town and any potential occupant of Newcastle roads or rights-of-way. February 14, 1983. vh THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 83-32 being a by-law to establish a policy in respect of occupancy of municipal roads and rights-of-way WHEREAS the Council of the Corporation of the Town of Newcastle wishes to establish a policy to require any persons, group or agency,. wishing to. occupy a Municipal Road or Right-of-Way for any reason which alters the normal use or status of same to apply and receive approval for, a Road Occupancy Permit, issued by the Director of Public Works; NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS AS FOLLOWS: 1 . THAT the policy in respect of occupancy of Municipal Roads and Rights-of-way shall be as set out on Schedule "A" attached hereto.
