SUBJECT: CORRESPONDENCE FROM MR. F. SHANE OF DARLINGTON
AUTO CENTRE INCORPORATED RE ACCESS FROM SAID
ESTABLISHMENT TO CHURCH STREET, BOWMANVILLE
RECOMMENDATION:
It is respectfully recommended:
1. That Darlington Auto Centre Incorporated be advised
that the Town does not approve of eliminating parking
spaces on Church Street in the vicinity of said
business;
2. That Darlington Auto Centre Incorporated be further
advised that the cost of relocating parking meters or
altering access can be undertaken only at the cost of
the party requesting such modifications.
BACKGROUND AND REPORT
Mr. F. Shane of Darlington Auto Centre Incorporated has
recently requested the Public Works Department to relocate
the parking meters adjacent to the front of their building
to the west so that the parking lot frontage at the east of
the building would remain unobstructed by vehicles using the
street parking spaces. Furthermore, vehicles displayed for
sale could easily be driven over the curb onto Church
Street. ,1��1 40'

In response, the Works Department took measurements and the
attached sketch illustrates the physical conditions which
exist at this location. An assessment of the situation
indicates that modifications could be accommodated, but at
some cost. Information related to cost and other aspects
was forwarded to the owner in the attached letter. The
owner then requested a discussion and a meeting was held on
site. At the meeting it was realized that in addition to
the modifications suggested above, the owner was also
requesting that the parking space at the east side of the
entrance to Darlington Auto Centre be eliminated. The owner
was requested to document his desires and disagreements with
the position and policies as previously specified by the
Director of Public Works.
The attached letter from Darlington Auto Sales states that:
1. A safety hazard exists because cars parked on Church
Street obscure the view of traffic exiting from
their parking lot;
2. The present parking spaces on Church Street hamper
their operation;
3. That the Town make the requested modifications and
absorb the costs.
In response to Item l: there is no more potential for safety
problems at this location than at any other location in
Bowmanville where parallel parking is provided on the
street. For example; a similar condition exists at the
entrance to the L.C.B.O. parking lot immediately adjacent to
the business in question and no safety problems exist.
Traffic volumes using the L.C.B.O. entrance are very high
and there is no history of accidents at this location.

With respect to Item 2: the parking spaces on Church Street
do stand between the Auto Centre parking lot and the
street; however, those were the conditions under which the
business was established. Perhaps re-orientation of the
spaces on the site of Darlington Auto Centre would
facilitate movement of vehicles.
With respect to Item 3: there are limited parking spaces
available in the Town, a fact which makes it undesirable to
eliminate further spaces. Furthermore, the Town' s Entrance
Policy states that any party requiring an entrance or
modification to an entrance is responsible for costs
associated with same.
An assessment of the relevant facts indicates that the Town
has no obligation in this matter and that if Darlington Auto
Centre wishes to modify their entrance, appropriate
arrangements, financial and otherwise, should be made.

Dear Sir;
In response to your let-ter dated February 3, 1983, we wish to
advise that we are not pleased with the proposal presented to
use
We have had visits from several people from the town to inspect
our problem. They are all in agreement with us that the positions
of the parking meters are a traffic hazard because they obstruct
the view of outgoing traffic if a vehicle is parked at the end
meter. We feel -that the proposed location is where they should
have been originally located. The present location also makes
it difficult to operate a car lot because, when a car is parked
at -the end meter we cannot remove some cars from the lot until
the parked car leaves.
We have been in business at this location for over six year and
during -that period have paid in excess of $25, 000.00 in business
and property taxes . We feel that for the service we receive from
the Town that we contribute our fair share of the Town' s income®
We are not asking for any new construction, only asking that a
correction of a traffic hazard be made. Because of the large a:�
mount of taxes we pay each year, we feel that the Town can well
afford to correct this problem from their revenue and not ours.
We trust that you will complete this work properly for us and that
you will pick up the bill for the work involved. Hoping to hear

Dear Sir:
RE: Relocation of Parking Meters on Church Street
Adjacent to Darlington Auto Centre
The Mayor has advised that you are interestd in having two parking
meters adjacent to your business relocated to permit a wider
entrance to your east vehicle lot. The situation has been
investigated and we have found that, in accordance with the Town's
Entranceway Policy, you are entitled to a wider entrance (up to
about thirty (30) feet in total ) and that the parking meters in
question could be relocated to accommodate a wider entrance.
Assuming you would like to widen the entrance about fourteen (14)
feet, estimated costs would be as follows:

1. Application for Entrance $ 30.00
2. Curb Cut 14'@ $10.00 $140.00
3. Reinstatement of asphalt blvd. $ 50.00
4. Relocation of parking meters $100.00
TOTAL COST $320.00
On the basis that you require a wider entrance, the Town would be
willing to relocate the parking meters; however, we see no need to
move the meters unless the entrance is widened. We definitely do
not agree with vehicles driving over curbs at locations other than
where the curb has been cut out for this purpose.
