SUBJECT: CONSTRUCTION BY-LAW FOR THE RECONSTRUCTION OF
THE KING STREET CONNECTING LINK FROM WEST OF
BALDWIN STREET TO EAST OF BEAVER STREET IN THE
FORMER VILLAGE OF NEWCASTLE.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and,
2. That the attached Construction By-law for the
reconstruction of the King Street Connecting Link
(Highway # 2) from west of Baldwin Street to east of
Beaver Street in the former Village of Newcastle be
passed; and,
3. That the Mayor and Clerk be authorized to execute the j
said Construction By-law forthwith, so that it may be
submitted to the Minister of Transportation and
Communications for approval .

Background
The project for reconstruction of the King Street Connecting
Link in the former Village of Newcastle is included in the
Town's 1983 Budget and is at a stage where tenders for
construction may be called. However, since the Ministry of
Transportation and Communications (M.T.C. ) contributes the
bulk of funds for the project, they require a construction
by-law from the Town and approved by the Minister prior to
any action being taken. Accordingly, it is imperative that
the attached by-law be passed forthwith.

Report
The cost apportionment indicated in Appendix 3 shows total
cost allocations which result in cost-sharing as follows:
1. M.T.C. - 90% of $741,792.37 plus 50% of $5,012.00
_ $670,119.13.
M.T.C. has allocated $594,000.00 towards this project in
the 1983-84 fiscal year leaving about $75,000.00 carry-
over into 1984-85. This, of course, is assuming the
costs come in as estimated. With the recent competitive
market conditions this could be reduced substantially.
M.T.C. have indicated no difficulty in the carryover
costs.

2. Town - 10% of $741,792.37 plus 50% of $5,012.00
plus $55,260.47 = $131,945.71.

The Town has allocated $113,000.00 in 1983 to cover its
share of the project leaving about $20,000.00 as a
carryover into 1984. Again, this assumes estimated
costs.
3. Others - $167,042.16 broken down as follows:
B.I .A. $45,264.76
Hydro $70,328.28
Street Lighting Acct. $47,249.12
Bell $ 4,200.00
In this area, the funds available to the B.I .A. are
insufficient based upon the estimates; however, once
tenders are in, certain components can be eliminated to
bring them in line.
With regard to the cost apportionment, it should be noted
that the estimate of $55,260.49, chargeable to the Town,
consists of sewer oversizing, sidewalk and hookup of
basement drains and downspouts.
The contract is set up to be constructed in four stages with
the first three, which include construction from Baldwin
Street to Beaver Street, taking place in 1983, and the
remainder in 1984. Asphalt surfacing, i .e. , the top course
will be completed in 1984, also. Total cost of 1983
construction is estimated at $467,474.00 with a total cost
of $277,000.00 for Stage four in 1984.

Of the total project cost of $969,107.00, some $360,000.00
will be required in 1984 to complete the works including
holdback. The matter of staging has been discussed with

both M.T.C. and the Newcastle B.I .A., who are in
concurrence.
The contract will be advertised on June 30th and July 8th,
closing on July 19th, 1983. Work is scheduled to commence
on August 8th, 1983, and a total of ninety (90) working days
has been allocated for completion of the entire contract.
The contract includes installation of all ductwork for
street lighting and hydro supply, and the supply and
installation of decorative lighting. Durham Works
Department will adjust traffic signals at Mill and King
Streets.
To maintain the proposed schedules, it is important that
Council deal with this matter immediately. Once the by-law
is executed, four copies of it, as well as form AB-PR-3
(Appendix 3) , must be submitted to the Minister for
approval . This will be arranged through the Town's
consultants.
