SUBJECT: TOWN OF NEWCASTLE PARTICIPATION IN PROGRAM FOR THE PROVISION OF DESIGNATED PARKING SPACES FOR THE HANDICAPPED. RECOMMENDATION: It is respectfully recommended : 1 . That Report WD-52-83 be received; and , 2. That the Public Works Department , with the approval of certain area agencies and organizations , be authorized to designate certain areas , off-street, for parking spaces for the handicapped; and , 3. That the attached by-law, to permit certain on- street parking of vehicles operated by , or for, physically handicapped persons , and the issuance of permits in respect thereof , being an amendment to By-Law 79-1 (Parking ) , be recommended to Council ; and , 4. That Council be asked to designate an account from which an initial amount of $2,000 (Two Thousand Dollars) may be drawn to implement the first stages of the program; and , 5. That the Region of Durham be requested to issue permit applications to those residents of the Town of Newcastle who will qualify to use the special parking facilities , and be advised of the steps taken in implementing the program. ?r V ,<< WD-52-83 ` 2 BACKGROUND: On March 7 , 1983 , Report WD-20-83 was approved by Committee and the Public Works Department was authorized to contact various area agencies and organizations with a view to gaining input into the proposal to provide special parking facilities for the use of handicapped persons , primarily within the urban areas of the Municipality. The proposed program parallels the Province of Ontario's request that the need for parking facilities for the handicapped be recognized by all municipalities , and the project, spearheaded by the Region of Durham, to establish a reciprocal agreement with Metropolitan Toronto with respect to permit issuance and the use of designated parking spaces by the handicapped. REPORT: t On May 17, 1983 , a meeting was held in the Hampton Municipal Office attended by Councillor Diane Hamre, Mr. Doug Manuel (representing Handi-Transit and the Newcastle Social Planning Council ) , Mr. Len Koenderman (for Bowmanville Business Centre) , Mr. Fred . Couch (Newcastle Community Hall Board) , and Staff. The primary items for discussions and resolution were as follows : 1 . The scope of the program. 2. Primary locations. 3. Administration. 4. Publicity. The consensus of opinion was that the above matters should be resolved thus: 1 . The Scope of the Program. Designate a modest number of special parking spaces initially (in Bowmanville and the Villages of Orono and Newcastle); monitor the use and establish the needs , and expand the program in accordance with the demonstrated demand. WD-52-83 - 3 - 2. Primary Locations : Off-Street: Specially-designated spaces at or near urban centres were favoured; parking lots , whether on private or Town-owned property , would more readily accommodate the requirements , and could be easily adapted for the purpose. To this end Staff have approached the appropriate principals and have received their co- operation and approval in the proposal . On-Street: Parking spaces , specifically designated for, and restricted to , use by vehicles operated by or for the handicapped are not easily accommodated in busy , central areas. The problems inherent in any scheme for on-street parking range from the physical nature of the street (width , traffic volume , etc. ) to the abuse of facilities and the need for dil- igent enforcement. The Region of Durham's Traffic Advisory Committee will be addressing the overall question of on- street special parking , with a view to area standard- ization and guidelines , and it is felt the Town of Newcastle should actively participate in the meetings and implement this aspect of the program at a later date. For the present , it is felt that an amendment to By-Law 79-1 would accommodate any requirement for on-street parking and , at the same time , would govern the issuance of permits indicating that the vehicle is operated for, or on behalf of , a disabled person. 3. Administration: The Region of Durham has requested Metropolitan Toronto to handle the issuance of permits and general administration associated with same, on behalf of the Region. Applications for permits will be obtained from the Region and forwarded to Metropolitan Toronto for processing and issuance. WD-52-83 - 4 - 4. Publicity: The Handi-Transit agency will inform all those with whom it deals of the availability and locations of specially designated parking spaces in this area. Handi-Transit will advise the Town of the response, and will assist in determining requirements for more facilities and expansion of the program. It is felt that, once the initial spaces are properly established , the local press should be advised , by which means those who will benefit from the program will be aware of the facilities , and others will not abuse them. Further to the foregoing , there remained the matter of any costs incurred: As the Town was asking the owners of some private lots to "donate" parking space for the handicapped , it seemed reason- able that the Town would defray any associated expense related to signing , line painting , modification of curbs (ramping) , etc. It is not possible to establish a single cost per space , as this will vary according to whatever modifications are needed to achieve an acceptable facility. Staff has, however, determined that the minimum value of a sign and post would be $85. 00. , and labour/equipment and any other materials required would be additional . It is proposed that ten signs be obtained initially and , other projects and programs permitting , that student labour be used as far as possible (line painting, etc.) Since the Meeting of May 17 , 1983, with the active assistance of those present , permission has been given to locate specially designated parking spaces as follows : BOWMANVILLE: Shopping Mall , King Street. 3 spaces. Memorial Hospital . 2 spaces (Actual location will be advised in the near future) . 10) WD-52-83 - 5 - NEWCASTLE VILLAGE: Community Hall 2 spaces. VILLAGE OF ORONO: L.C.B.O. Lot 1 or 2 spaces It is anticipated provision will be made for other spaces in the new Bowmanville B. I.A. May 27, 1983. f �/ :vh BY-LAW No. 83-81 OF THE CORPORATION OF THE TOWN OF NEWCASTLE Being a by-law to amend By-Law 79-1 to authorize certain on-street parking of vehicles operated by or for physically handicapped persons and the issuing of permits in respect thereof. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a By-Law of The Corporation of the Town of Newcastle , through its Council thereof as follows : DEFINITIONS: 1 . Except where provided in Section 2 hereof , the definitions in Section 1 of The Corporation of the Town of Newcastle By-Law No. 79-1 , as amended , shall apply to this by-law. 2. For the purpose of this by-law: 1 ) Permit - shall mean a permit issued on an annual basis to a physically handicapped person by the Municipality of Metropolitan Toronto. 2) Physically Handicapped Person - shall mean a physically handicapped person as defined in the Municipality of Metropolitan Toronto By-Law No. 192-79 , Section 1 (2) , as amended from time to time. ISSUING AND USAGE OF PERMITS: 3. 1 ) Issuance of Permits: The Commissioner of Roads and Traffic of the Municipality of Metropolitan Toronto is hereby authorized to issue permits to physically handicapped persons to allow on- street parking of vehicles operated by or for physically handicapped persons. 2) Issuance of Identifying Marker: The Commissioner of Roads and Traffic of the Municipality of Metropolitan Toronto is hereby authorized to issue i I ' I an identifying marker to be used in connection with a permit issued pursuant to Subsection 1 of this section. 3) Use of Permit Restricted : No person other than a physically handicapped person shall acquire a permit allowing parking of vehicles operated by or for physically handicapped persons. 4) Use of Identifying Marker Restricted : No person , other than a physically handicapped person who has lawfully acquired a permit pursuant to Sub- section 1 of this section shall acquire or use an identifying marker issued in connection with a permit. 5) Manner of Use: No person shall use , other than in the manner provided for in this by-law , an identifying marker issued in connection with a permit. 6) Displaying of Marker: (i ) The identifying marker issued in connection with a permit shall be affixed to the sun visor of the driver or passenger side of the motor vehicle operated by or for a physically handicapped person and such identifying marker shall be affixed in such a manner so that it is readily visible from the outside of the vehicle when the visor is turned down . (ii ) An identifying marker issued in connection with a permit shall be deemed to be properly displayed when the visor is turned down and the identifying marker is readily visible from the outside of the vehicle. GENERAL STOPPING AND PARKING REGULATIONS: 4. Notwithstanding the provisions of any sections of Town of Newcastle By-Law 79-1 and notwithstanding the display of auth- orized signs to the contrary , where a vehicle operated by or for a physically handicapped person in respect of which person a permit has been issued and on which vehicle an identifying marker issued in connection with said permit is properly displayed , the owner and the driver of such vehicle is exempt from the following provisions of the by-law: 4. (a) Section IV and V dealing with "Parking" , provided that no such vehicles shall be parked on any highway pursuant to these sections for a period exceeding 24 hours , it is further provided that this exemption shall not apply to the owners and drivers of any such vehicle on highways designated as being a "Snow Route". (b) Section VIII dealing with parking meters during the hours when the meter is legally in operation. PENALTIES: 5. Any person who contravenes any of the provisions of this by-law is guilty of an offence and shall be liable upon conviction thereof to a fine of not more than $25.00.
