THAT Report PD- 163 -96 be received; 2. THAT the Roster of Consultants for the Preparation of Environmental Impact Studies, as indicated in Section 2.3 of Report PD- 163 -96, be approved, and remain in effect for the period from December 2, 1996 to December 1, 1999; 3. THAT Purchasing By -law #94 -129, Section 5, Paragraph 5.13, be waived for the term of the Roster. 1. BACKGROUND 1.1 Section 4.3.8 of the Clarington Official Plan requires that an Environmental Impact Study be prepared for any development application located on or adjacent to a Natural Feature identified on Map C of the Plan. The Municipality is to retain qualified professional expertise to undertake the Study, with the cost of the study to be borne by the developer. 1.2 On October 7, 1996, Committee considered Report PD- 132 -96 which forwarded Guidelines to implement Section 4.3.8 of the Official Plan. The Guidelines indicate that the Planning Department will develop and maintain a roster of consulting firms qualified to prepare Environmental Impact Studies. When a development application is submitted that necessitates the preparation of an Environmental Impact Study, only those consultants on the roster would be invited by the Municipality to submit a proposal. Staff will seek Council's authorization to renew the roster in three (3) years. 1.3 Report PD- 132 -96 recommended that the Guidelines be endorsed, and that Staff be authorized to seek Expressions of Interest from qualified consulting firms in order to recommend a roster of consultants to Council for consideration in the preparation of Environmental Impact Studies. Committee and Council approved the Report's recommendations. 2. CONSULTANT SELECTION 2.1 The Municipality issued a Request for Expressions of Interest on November 5, 1996, with submissions due on November 19, 1996. A total of fourteen (14) Expressions of Interest were received (see Attachment No. 1). A number of the Expressions of Interest incorporate sub - consultants in order to provide the range of environmental expertise required by the Municipality. 2.2 Planning Department Staff reviewed the Expressions of Interest in consultation with the Manager of Purchasing, and staff from the Central Lake Ontario Conservation Authority and the Ganaraska Region Conservation Authority. As a result of this review, seven consulting firms were short- listed and interviewed. 2.3 The short- listed firms were interviewed by Planning Department Staff, the Purchasing Manager, and CLOCA staff. As a result of the consultant interviews, the following firms are recommended for inclusion on the Municipality's Roster of Consultants for the Preparation of Environmental Impact Studies: o Aquafor Beech Ltd. in association with Beak International Inc. and Geomatics International o Bird and Hale Ltd. in association with Hough Woodland Naylor Dance Ltd., G.M. Sernas and Associates, Azimuth Environmental Consulting Inc. and Shoreplan Engineering Ltd. PAGE 3 o Ecological Services for Planning Ltd. in association with Terraprobe Ltd., Cosburn Patterson Mather and IMC Consulting Ltd. o Gartner Lee in association with R.V. Anderson Associates Ltd., Baird and Associates Ltd. and PMA Landscape Architects. 3. CONCLUSION 3.1 Subject to Council's approval, the Roster of Consultants will come into effect immediately and remain in effect until December 1, 1999. Under the Guidelines approved by Council, the Director of Planning is authorized to enter into contracts with the firms on the Roster for the preparation of individual Environmental Impact Studies. 3.2 As noted earlier, the cost of individual Environmental Impact Studies will be borne by the development proponent. As such, there are no financial costs to the Municipality in approving the Roster of Consultants. In addition, if it becomes apparent that any one of the consultants is not performing adequately, the Director would not include that consultant in subsequent tenders. 3.3 A competitive bid process was used for the selection of the firms and the Expressions of Interest included hourly rates which may not be exceeded for the term of the Roster. As such, Purchasing By -law #94 -129, Section 5, Paragraph 5.13, which indicates the need for Committee and /or Council approval for Consulting and Professional Services costing more than $20,000.00, should be waived for the term of the Roster. DISCUSSION 1 have prepared a draft bylaw (copy attached to implement Recommendation No. 3 contained in above Report. The By -law will authorize purchase orders for Environmental Consulting and Professional services to be undertaken by a firm which is on the approved roster, to be issued by the Director of Planning and Development in circumstances in which the services will cost less than $25,000.00 and the funds are provided in the appropriate budget. Contracts for services costing more than $25,000.00 will continue to be made by a formal agreement executed by the Mayor and Clerk or a purchase order issued by the Purchasing DEC 09 '96 13:01 ROBBINS APPLEBY TAUB - Page 2 - P.3 Agent as provided in section 5.13 of the Purchasing By -law, (fay -law No, 94 -129, as amended). In order to avoid any possibility of future confusion, I recommend that Recommendation No, 3 of Report #PD- 163 -96 be deleted and replaced with the following: #3. Barrie DEC 09 '96 19:01 ROBBINS APPLEBY TAUB P.4 BYLAW NO. 96- being a by -law to amend the Purchasing By -law, By -law No. 94 -129, as amended respecting Environmental Consulting and Professional Services WHEREAS at its meeting on December 9, 1996, Council approved the recommendations contained in Report #PD- 163.96, as amended, NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON ENACTS AS FOLLOWS: 1. Paragraph 5.13 of By -law No. 94 -129, as amended, is further amended by adding the following at the end of the first sentence thereof: "Where the initiating Department is the Department of Planning and Development and the Consulting and Professional Services are to be provided by one of the firms indicated in the Municipality's Roster of Consultants for the preparation of Environmental Studies referred to in Report #PD- 163 -96, a purchase order for the services may be issued for the Municipality by the Director of Planning and Development."
