Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report PD- 154 -96 be received;
2. THAT Staff be authorized to take the appropriate action pursuant to municipal
policy and the provisions of Section 210 (111) of the Municipal Act, for
consideration of the proposed street name change of "SOMMERSCALES" Drive
to "SOMERSCALES" Drive.
3. THAT the landowners fronting onto Sommerscales Drive be provided notice
through direct mail circulation.
1. BACKGROUND
1.1 A number of years ago the Planning Department prepared a list of eligible street
names for use within new plans of subdivision. All the names on the list are of
historical significance to the Municipality. The list is made available to developers
once an application for residential development is draft approved and prior to
registration.
1.2 Shortly after Plan of Subdivision 18T -87087 was draft approved, the developer's
consultant selected a number of names for the draft Plan of Subdivision. The

Municipality, in turn, forwarded the names chosen by the Developer to the Region
of Durham Planning Department for approval.
1.3 The Region confirmed, in writing, their acceptance of the street names proposed
for the Plan of Subdivision. Unfortunately, the name Somerscales was incorrectly
spelled "Sommerscales" in their return correspondence to the Municipality. This
error was not detected by staff or the consultant on behalf of the developer. The
Region's letter was ultimately used in the preparation of the street names on the
40M Plan for the first phase of Plan 18T- 87087, hence the misspelling of the street
name Somerscales Drive.
2. STAFF COMMENTS
2.1 The error in the spelling of the name Somerscales was brought to staff's attention
by a member of the Somerscales family who noticed the misspelling on the street
name sign.
2.2 The provisions of the Municipal Act stipulates that whenever the Council of a
Municipality wishes to change a proposed street name, a notice is to be placed
in the local newspaper(s) serving that Municipality, announcing Council's
intentions. Although this particular circumstance does not propose to change the
street name as approved, the Municipal Act does not provide any other means
to correct the spelling of a street name other than as described above.
2.3 It is staff's opinion that inasmuch as the Plan of Subdivision has just recently been
registered, the appropriate time to correct the spelling of the street name is prior
to the issuance of any building permits and eventual occupancy in the
subdivision. To that end, the developer /builder has been requested to advise all
future purchasers of the 64 townhouse units on Sommerscales Drive of the
correct spelling of the street name.

3. RECOMMENDATION
3.1 Pending Committee and Council's approval of the recommendations contained
within said report, staff will proceed with the appropriate newspaper
advertisements for four (4) consecutive weeks in accordance with the procedures
set out in the Municipal Act.
