REPORT NO. : WD-34-83 SUBJECT: REQUEST FROM MR EDWARD HOLYOME TO PLACE A STREET LIGHT ADJACENT TO HIS PROPERTY ON THE OSHAWA/NEWCASTLE TOWNLINE ROAD APPROXIMATELY 0.5 MILES SOUTH OF TAUNTON ROAD RECOMMENDATION: It is respectfully recommended: 1. That the request of Mr. Edward Holyome for placement of a street light adjacent to his property on the Oshawa/Newcastle Townline Road, approximately 0.5 miles south of Taunton Road, be denied; and, 2. That a copy of this report detailing alternatives to the original request be forwarded to Mr. Holyome for his consideration. REPORT: The request of Mr. Holyome is subject to an unusual set of circustances which makes determination of the responsibility for street lights difficult. Firstly: Townline Road is a Regional Road which would suggest Regional responsibility; however, the Region assumes no jurisdiction over street lighting. l�' 2 - Secondly: being a boundary road, it must be determined whether street lighting on Townline Road is a Newcastle or Oshawa responsibility. Since the strip residential development which would benefit from the lighting is on the Newcastle side of Townline Road, it is only reasonable to assume that associated costs would be a Town responsibility. On other sections of Townline Road where the houses are on the City side, street lights have been installed by the City. Finally: the agency which would install and maintain the street lights is the Oshawa Public Utilities Commission which further complicates the matter. With respect to Mr. Holyome's request, it would not be logical to install a single light, but rather place a complete lighting system through the area where the strip development exists. This would require installation of about six (6) lights at an estimated cost of five hundred dollars ($500. ) per installation (assuming lights are installed on the existing poles on the west side of Townline Road) . Town policy, (see attached) will only provide for such installation as a local improvement. Accordingly, the notion of the Town initiating and paying for lights on the west side of Townline Road in response to Mr. Holyome's request is precluded. Mr. Holyome does, however, have two other options he can pursue, namely: 1. Attempt to have the lights installed as a local improvement; 2. Install an outdoor light on his own property. /VVV _ 3 _ With respect to the first option, Mr. Holyome could encourage his neighbors to support a petition for the lights to be installed under local improvements. Such a petition would require support of two-thirds (2/3) of the benefiting property owners whose assessment would represent fifty percent (50%) of the value of the benefitting lands. In this case there are about twelve (12) properties involved which would result in an initial cost of approximately two hundred and fifty dollars ($250. ) to each owner and subsequently� a nominal annual operating cost. The second option suggests that Mr. Holyome install a farmyard type light on his own property to ensure his own safety. As Mr. Holyome has indicated in his letter of request that he is prepared to participate financially, this option might appeal to him. In summary, the Town's policy for street lighting does not make provision for the municipality to respond positively to Mr. Holyome's request, however, there are other avenues he can pursue. With respect to the local improvement option, Staff would be pleased to discuss procedures with Mr. Holyome. By copy of this report, Mr. Holyome should be made aware of the Town's position and the other options available to him. Respectfully submitted, R.G. Dupuis, P. The installation of new Street Lights be considered only under Local Improvement, save and except those installed in accordance with a Development Agreement or other Agreement with the Town. 2. The replacement or update of existing deficient Street Lights be in accordance with the annual approved Budgets. 3. Replacement and /or update resulting from road and street construction be in accordance with the annual approved Budget. 4. Street Lighting required external to new development (or which becomes deficient as a result of new development) be funded by incorporating the additional cost in the calculations of Lot Levies. Dear Sir; It is not a matter of mere desire, it has become a matter of necessity that a regular street light be installed in front of my property. In fact it has become a matter of life and death. My life. For 5j years now I have suffered beer and wine bottles smashed down my lane way and against my mail box. Even my new mail box, that I had to buy has a large dent in it now. Also on Feb. 4, 1983, last month my front lawn was deliberately ripped up by a motor vehicle. Also two weeks ago, on Feb. 19, 1983, a rifle bullet was fired through my kitchen into my living room coming to rest beside my chair I was sitting in. This shooting incident is currently being investigated by Detective Webster (Ext. 336) of the Durham REgional Police. All these incidents occur between midnight and 3 o'clock in the morning the darkest part of the night. Putting a regular street light in front of my property would go a long ways towards deterring these incidents as we could possibly be able to see and identifie who ever is responsible for these criminal acts, while I am still alive that is. I understand that the cost and maintenance of said street light would come on my property tax bill . It would be worth the added cost for the added security. My property is situated on Townline Road N. , east side of road right across from the small hydro sub station and apple orchard. See attached map drawing of area plus a copy of my property tax bill and hydro bill for reference purposes. P.S. Actually a second light in Edward Holyome front of my brothers house Townline Rd. N. , Oshawa 200' further north, would L1H 7K5. be a good idea too, but Part Lot 35, Conc. 4 anyway it definitely needs Township of Newcastle one in front of my small house and property.
