REPORT NO. : WD-64-83 SUBJECT: ROAD CONSTRUCTION ® LOT 19, CONCESSION 3, DARLINGTON FOR TERRY AND JOHN KLAWITTER. RECOMMENDATION: It is respectfully recommended: 1. That the Director of Public Works be authorized to construct approximately sixty feet (60 ft. ) of road allowance between Lots 18 and 19, Concession 3, Darlington, from approximately 3,470 feet north of Nash Road to 3,530 feet north of Nash Road to accommodate the entrance application of Messrs. Terry and John Klawitter; and, 2. That the total costs of constructing the road, complete with gravel base, prime and surface treatment, be paid by Mr. Klawitter, and that Mr. Klawitter be required to submit a performance guarantee in the amount of the Works Cost Estimate to the Treasurer; and, 3. That upon completion of the construction, the Town assume the section of road for maintenance. . . .2 �9 d 2 - BACKGROUND AND REPORT Messrs. Terry and John Klawitter, owners of approximately one hundred acres of agricultural land situated in the north half of Lot 19, Concession 3, have requested an entrance off the unmaintained portion of the road allowance between Lots 18 and 19, Concession 3. The location of the entrance is to be in the south-east corner of the property and requires the construction of approximately sixty feet (60' ) of road. This section of road is estimated at $40.00 per foot and includes clearing, grubbing, excavation, placing of granular materials, priming and surface treatment. The total estimated cost is $2,400.00. The entrance installation will be an additional $460.00, in accordance with the Town's Entrance Policy. It is proposed that the work be completed by Town forces upon Mr. Klawitter depositing with the Treasurer, satisfactory financial guarantees for the works. Respectfully submitted, R.G. Dupuis, P. Id Dear Sir, I am inquiring as to the permission and costs involved to acquire an entrance permit onto the subject property. Subject Property: Part Lot 19 , (Nz) Cone . 3 , Town of Newcastle Formerly Township of Darlington, Now Region of Durham Consisting of one hundred acres. Owners: Terry and John Klawitter. Previous Owners: Gary and Susan Jefferys. The east boundary fronts onto Maple Grove Rd. The north boundary fronts onto the fourth line . ( See sketch #1 ) Maple Grove Road is maintained up to and possibly north of our southern property line . We would like to put the entr- ance in the south east corner, (see sketch #2) with the inten- tion of building a home on this property. We are aware there may be costs to upgrade some footage of the unmaintained road at our expense . Would you please give us a breakdown of these costs. In order for a lot to be considered a building lot, it must front on a road maintained by the Town. The subject lot is zoned "A" (Agricultural ) by By-law 2111 of the former Township of Darlington and the minimum road frontage required for -an agricultural use is 100.5 m (330 feet) , The Public Works Department has advised us that the Town maintains Maple Grove Road up to the edge of your property, but that you have indicated a willingness to improve the length of road necessary to obtain a building permit. The Public Works Department has also indicated their intention to assume the maintenance for sucn improved frontage. By-law 2111 states that "where a lot having a lesser frontage , . than that required herein is held under distinct and separate ownership from adjacent lots at the time of passing of this by-law . . a building may be erected and used on such smaller lot provided that it conforms to all other requirements of this by-law." Based on the information you have provided, the subject lot was created before December 4, 1958, the date on which By-law 2111 was approved by the Council of the former Township of Darlington. As such, the lot is exempt from the minimum frontage requirement. The Public Works Department has indicated that you will require the construction of an entranceway. Based on the above, you will only be required to improve sufficient road frontage to meet the Public Works Department's requirements for an entranceway.
